There are those who have gone through the process of working with Eagle and the EPA, they get their permits, they adhere to their limits, and they operate in a manner that respects the community and then frankly, and we all know this there are those who don't and I fear that this ordinance has the potential to drive the good operators away, which certainly is not what we what any of us want. The good operators have a proven track record of demonstrating that they can and do follow the rules. However, with this ordinance, I fear there's a real risk that the good operators will feel they can no longer comply with enhanced regulations and the leave and the leave the bad operators remaining in the city. So I encourage the city council to partner with the community with with operators as well to seek feedback and to gain an understanding of what is entailed in order to make sure that what is proposed and voted on is something that will achieve the outcome we all desire. Dust and air quality more broadly has a demonstrably negative impact on quality of life here in Detroit. The American Lung Association just gave Wayne County and F for air quality. This issue is not going to resolve itself on its own. We need comprehensive rules that give the city power to act on violations including increasing fines and crucially, the ability to stop operations of a facility continues to violate us restrictions. In the future. I hope the council consider expanding rules to include air quality monitoring and ensure bc it has the staffing to address complaints in a timely manner. I'm here to support a fugitive dust ordinance but I want to give a couple of different ways other than what's on your agenda today that you might do so and that is about preventing polluters from getting in a position to do the harm to our atmosphere and air that we breathe. One is the EV battery plant. Everyone knows you can see the regulatory agencies and everything knows that this is toxic and it's going to be harmful to a residential neighborhood that's emerging on Paquette Avenue. Yet the city has just increased the tax chapters on October 10. You approved tax incentives for a different project. And the mayor without holding hearings is transferring it to another party who is doing a wholly different operation than what that was what was approved. That that sale was done. With two weeks after you approve this which means they were negotiating the sale while they were telling you they were going to build a distribution center. They were planning to sell it under under without telling you. This is a violation of the community benefits ordinance and it appears that the city has increased your tax incentives by $3 million. Also without hearings, as far as I'm concerned, they're not only deceiving the public, their county and the city council. They're bypassing your authority. Secondly, oh my gosh. I'm a business owner in Detroit, been here for about 20 years and had the opportunity to work with a lot of our local businesses and I'm here to speak briefly about the proposed amendment before you today on the fugitive dust ordinance. I've had the opportunity to work on that or advance with the last amendment back in 2017. And I just don't want to I want to express that you know, working with industry that we are 100% ensuring the same goal and support the ordinance moving forward and continue improvement on that. However, you know, when we last were we saw the you know, the hard work that was going on in the committee back in November. And we when industry came to the table and brought some some suggestions in order to have a discussion around trying to make sure we would be able to come up with a way to appropriately enforce it to appropriately look at ways to generate the revenues needed if that if there was you know, suggestions on that for BC those were things that came up in 2017 and we were just surprised of how fast because we have had no contact since sitting like my last contact personally was in December. And we know that you know it was a number one priority. But we really are asking that we would just have an opportunity to be able to see to have that discussion. Just to go over some of the pieces that today conflict with some of the application and how do we get there and are there you know, what would be reasonable if there's any opportunity to incorporate any of the suggestions that were presented? So I just asked you as an effort to move forward that we could maybe have that moment. Reflect on that.

And we are here to express support for the proposed fugitive dust ordinance and it's aimed to enhance our quality in our city. However, we think there are some changes that are needed to ensure that it is effective and doesn't have unintended consequences. The ordinance requires no activities with future death with opacity greater than 5%. Yet 5% is very barely visible to the human eye. Eagles establish capacity limits from fusions of sources from five to 20% levels based upon the source and every community establishment that has a car driven on a paved or unpaved area and parking areas does does lawn maintenance will exceed 5% opacity. We respectfully suggest to the city review the science behind opacity and established standards consistent with Eagle and EPA. Also the ordinance requires corrective measures be instituted in a very short time of only two weeks. This would require businesses shut down for dust events that truly don't cause a health impact due to the to the community given the miniscule capacity percentages, a small event that could create a disastrous impact on local businesses as long with community construction projects. Again, we respectfully requested the timeline to implement corrective actions be increased. The ordinance requires a lot to be put on BC to evaluate, approve and enforce the ordinance lays out specific times for BC to act however, nothing is laid out for BC if they do not respond in a timely manner. Again putting a burden on business but also impacting you.

And I think that this ordinance that the Human Trafficking Task Force has put together or put forward help before it will let people know all the time where they can get help. So 24 hours a day, where people who are being trafficked and according to the national hotline, human trafficking national hotline, the number one place for people being sex trafficked is hotels and motels. So I think that this ordinance will give us a chance to keep people from being victimized and the people that are being victimized to have 24 hour access to information that they can get help immediately. That's why it's with a sense of great urgency that I address you today as a staff attorney with the Great Lakes Environmental Law Center in support of the proposed dust ordinance. This proposal would represent a step for from our city towards elevating the health of all residents to the status of non negotiable priority. In its current form, its promise of investing into the health fund underscores the immediate and tangible impacts it could create throughout Detroit. However, while we Herald this advancement, a significant component is absent that of fenceline monitoring. We don't need to wait for the reparations Task Force to provide a modicum of immediate relief and long term protection to those who have endured decades of environmental racism. By implementing fenceline monitoring. This council would be taking an absolutely critical step towards directing or directly addressing the burden of unchecked industrial pollution, disproportionately borne by black and brown. But I don't know how we're able to do that when we are 46% more likely to have asthma than any other Michiganders, and it's not fair for the residents of Detroit. So I would say Bed and Breakfast would be included in that definition. In addition, I remember yesterday at public hearing, there were some questions regarding putting this in multiple languages other than just English. It sounds like that's something that human rights is familiar with when dealing with all signage that that's something they include, to put this in to include Spanish, Arabic, whatever that they typically do. I would be happy to go first, Madam President, because I know I've spoken with a few of my colleagues, some industry folks and community folks, and would like to share some information on the work that we've been doing. So just so everyone knows we began this work back in 20. Chain 2022 We met with Community Law BC the City Planning Commission, and our planning development departments to really enhance the ordinance that we have currently. Or us. We brought this back from introducing it originally last year to do with BC to ensure that what we drafted was something that could be enforced. So industry community The city has for a while, and instead of forcing an ordinance last year, the BC did not feel they could enforce. We had been working with them since then to ensure that whatever we brought forward was something that could be enforced. There were two questions specifically that were brought up or two concerns from industry. And I'm wondering if we could allow for the Law Department to speak on summons that we received to make sure that we are sharing proper information. So one of the questions that are the concerns that we got regarding the opacity limits and also the the wind speeds that we have drafted in the ordinance. We'd like to make sure to confirm that this is already current the books that we are not making anything any more difficult than they wanted to currently is now I just wanted to confirm that with a lot of Parliament as well.

I will just also know that there was a mention that there was a varying opacity limitations in state law. First, it's not every instance. And second, those instances that it sounded like one public public comment or may have been referencing, or an MCL 3245524 and are carved out specifically in Section 593 of the ordinance before you. So if industry is compliant with those state requirements that allow for higher capacity, then they need to report as such to the city and they would be they will be in compliance with this ordinance.

So those were the main concerns regarding the policy that we were able to work through the other concerns we got concerns from community as well, noting that this ordinance is not strong enough that it's not doing enough to really help monitor the return in our communities, indicating that some industry is going to need air monitors on sites to be able to mitigate the dust and the seed has let us know that if there is an industry that requires an air monitor that that is something that they are going to ask them to have would like to see if crystal from BC is able to join us to just confirm that they are prepared and ready to enforce and to require air monitors from specific industries to make sure that we are monitoring their dust. Many of them are very valid questions around specific definitions. We are being asked to give examples of what a fugitive plan can look like on a city website. And these are all things that we are able to do. So we did ask BC if we could give some examples of a fugitive dust plan. And Miss Rogers you mentioned that we could do so correct. That is correct. And I would like everyone to know that my office works very closely with all the folks that are impacted by this and we will move forward with continuing to work with industry to hear your concerns to hear your ideas. Were discussing the future a Frequently Asked Questions portion on the website that can show certain industries if you have a question of your current operations. What is the change of operations, we can tell you what is a current operation change and what is not. I understand that this is a little opaque for folks. But I don't want this to be confusing. I want us to be on the same page and I want us to be able to provide protections that are desperately needed right now and understand the business needs to continue. I think that we can do both. I think that when there is a will there's a way and this is desperately needed. So again, appreciate industry for speaking with us. Many of them have said that they see the importance of it that they even support it. But I hear the need for us to work together on this and we will continue to do so. I also hear from industry. The biggest concern that I'm hearing is around enforcement of certain industries and certain bad actors. I wholeheartedly agree with you. And that is not an issue of policy. That is an issue of enforcement. I would even say that's an issue of politics that needs to be addressed that needs to be taken seriously that we cannot hold progress for moving forward. And I will let folks know that when we see bad actors in District Six community members residents will call our office we call on deseed. They go to the sites that are performing actions that they should not be performing and they will shut them down. So I want all industry to know that moving forward. I am working very hard with Reza to ensure that we are holding everyone accountable. And my hope is that moving this forward will continue to highlight which industry is doing the right thing and which industry we need to be holding account to. So those are my thoughts around what I hear. And I agree I wholeheartedly agree with you and it's not okay. But my hope is that we don't stop progress or moving forward. And then we continue to do what we have to do so to hold doser in bad actors accountable. With that. I would just like to lastly thank residents who are really the true champions. of this work. For me this is very internal, not only because I see the impact it makes on my neighbors, but because I live in southwest Detroit down the street from the Gordie Howe bridge and I see I see dust rolling down the streets. I see the suit that I'm breathing in. And I know to all of the dangerous particles in our fugitive dust that can lead to asthma and cancer and so many other life threatening illnesses. Somebody mentioned that the cost of business cannot be upheld above the cost of our lives. And right now residents are spending hundreds of dollars on air purifiers myself included and 1000s of dollars on medical bills. This ordinance is simply the right thing to do. And quite frankly, is very late in the game. We have done all that we could and we will continue to do all that we can to make sure this is enforceable. There's a comma there, that with this comment, I just want to make sure that that in the definition, this is the definition of fugi just with this section, a Dash 15 Dash five D through F that that will not mean or a be applied to a person doing human activity like riding their bike or more on their law. I just don't want a position where we're fun unnecessarily, unintentionally, but we're given out by the tickets to people who are not supposed to be receiving them because it's easier to do that to the guy and ride his bike than it is to do that to the industry. And let me say this, we need to be the biggest room in the world for approval. We need to be more aggressive in terms of going after that actors. I totally agree. And I think the fact that we haven't a new ordinance the VA do something that we shouldn't be doing already. I think it's shameful and tragic. I totally understand that. I just I just don't want this to be used or manipulated as going after the people who we're supposed to be protecting. If it happened, those people come before public timing. It includes various land uses such as scrap yards, as well as sort of activities such as moving of the moving of dirt or for facilities such as open storage, open storage yards. It does not make reference to the kinds of activities incidental activities related to individuals apart from a community establishment in identifying what a community establishment is, it also makes a point that what would not be included would be things such as single and two family dwellings, the kinds of places where, you know somebody may be riding their bike or may be cutting grass.

This is just the issue that we're learning about and figuring out what the tools are. Can you touch just a little bit deeper? I know you mentioned there's training relative to how to detect the percentage of opacity are there also tools that are utilized upon inspection when you go out to a site? Can we dive a little bit deeper into that please? No,

to the best of my ability and I I am not certified opacity. There is no special tools that are used other than a an inspection sheet where you record your measurements and you do have to record the measurements. While we are taking instantaneous measurements. It's not just one I go take a look and I say okay, yeah it's 20% or Yes, 6%. You do have to try and get a couple of measurements. So if there's a plume of smoke, you have to position yourself at a certain angle from the smoke or pull of dust. You have to be at a certain angle from the poem as well as the sun has to be at a certain distance. And I'm saying certain because once again, I am not a certified a pasty measuring person. We have had we have been doing this for some time. As this is a part of the book solid materials permitting process. So the people that we have, have been doing it for a while and they you know, they have we have not had any discrepancies when we go out and we're doing this with current industry. It has been okay, this is what we're measuring your pest yet and nine times out of 10 it with our industry locations. They also have someone on site that measures opacity, and they're able to concur and say yes, we agree and we you know, we're going to institute additional measures or, you know, we're not going to insert additional measures because there was no pass. We have not had discrepancies.

My second question, you know, revolving Opacity just goes to current issues that we have had even passed this past year through the Canadian wildfires, as well as seeing some of that smoke in the atmosphere. And just regarding inspection on a day, let's say hopefully, we don't experience that thick cloud of smog that we've seen and, and I don't know what percentage of passing that was, but I can say I saw that coming to work here every single day. How do we measure levels if an event like that is occurring, particularly during the summer months? Are they tested differently? Are we saying hey, we know this is going on right now. So it's kind of maybe a little bit impossible to do an inspection. Are there different tools utilized to measure that? What does that process look like?

So it's a it's a differential in measuring, so you're going to measure it against the background measurement, but if we had smoke, it would be very difficult to do a measurement. If we had smoked like some of the days we had last summer. If it's real hazy out. If it's raining, these are not days that we would generally be able to do or pass the measurements.

Right. But I guess that goes to my point. That's relative to the past the I know those days, you cannot want a my concerns is and again, I'll just be frank, if if this is happening on a day, and it's I think that that instance spread out for I think, a couple of weeks. Are we saying that we're not going to do any expected inspections in those two weeks and noting that, you know, obviously, the test for that air quality is a little bit different in detecting co2 in the atmosphere in the environment. This is just a naked eye test per se. But if that has to happen, do we not expect to have inspections during that time and that's a concern of mine. Because the whole intent of this ordinance is to be able to detect and ensure a fugitive dust is not happening and folks I like oh, what a smoke outside. Let me move more. Materials during this period than I normally will use that could be a concern not to state that, you know, some folks would do that. But you know, obviously it's a concern. What measures do we have in place to be able to monitor that in that type of event? If that happens?

That's a valid concern. Smog, not so much because smog generally, when it occurs, it's very moist. You know, humidity is pretty high, which tends to keep down your deaths but let's say you had a dry day where there were smoke dust coming from another location even as far away as as a forest fire. That is a concern. Now the specialists can take opacity measurements because again, the measurement is a differential. So you're gonna measure the difference between what's coming up in the plume versus what the background is. It is not the best way to measure opacity, but it is possible to do so if we have some bad actors. I pretty firmly believe in this isn't the only day they're going to be bad. So we would have most likely been out there before and have established a relationship with these industries and let them know hey, you know your this is happening again and we need to institute whatever the next measure is on their fugitive dust plan.

Okay, that's helpful. And again, I ask these questions because what I don't want us to do and I know remember science everywhere murals work very hard on this is for us to pass an ordinance and there are some loopholes in there and folks feel like they can bypass this ordinance per se. And so that was one of my concerns. Another question was about timing for the corrective action plan. I think it right now is states. There's a two week timeframe that exists and one of the components upon that is BC approval. I asked this question from our table noting that I know BC does tons of inspections throughout the city of Detroit. What does the capacity of BC look like to ensure that let's say these corrective action measures are this plan is submitted to have that approval in a timely manner to ensure operation can continue.

We will need additional staff to ensure that this ordinance is enforced appropriately. I can tell you that it's going to be enforced primarily through the Environmental Affairs portion of BC in conjunction with property maintenance, and Environmental Affairs enforces the solid waste ordinance. Specifically the bulk file of materials so we're already enforcing this for those locations that have a bulk file of materials permit. What this will do is expand that enforcement to other types of industries that may be a medium fugitive does with that expansion. We will need additional staff to review fugitive dust plans approved them. But the number of inspections that we are required to do at this time is primarily limited to fugitive dust, whether it be for bulk solids or for this ordinance that's before the body now, you

And we saw that around $200 or 200,000, which is roughly what it would cost to hire one or two staff would be the impacts and it has been stated that we can it's in the budget, we would just have to reallocate the funds, which we can do. We could also use the fees that are collected from this ordinance to help with the hiring but quite frankly, I would much rather move forward with an amendment soon to hire the additional staff that are needed in the future, as as Ms. Crystal Rogers mentioned, would be needed to make sure that this is implemented well. But those are just you know, final, final comments. We've done the fiscal analysis we know what is needed to additional staff about another additional 200,000. We will continue to work with industry. Thank you, Madam President. I just want to send a few shout outs to the residents of district seven for this past weekend. Motor City makeover was absolutely amazing. Tons of residents came out helped clean up our communities and beautify our neighborhoods, so special shout outs to them. Also a big shout out to Detroit disability power had the opportunity to attend an event. They're just a great organization for our disabled residents here in the city of Detroit, very informative for residents and I thank them for welcoming me in to their facility. I also want to give a shout out to the seven residents who showed up yesterday for our policy, our policy session, the seven policy session. Special thanks goes to Commissioner Alicia Bell, who's the Chair of the Wayne County Commission for coming out and letting our residents know how county government works so very thankful to them as well as the Edison library for hosting us. Our next policy session is going to be June the 24th at the Edison library from 6pm to 730. So mark your calendars That's June 24 2024, from 6pm to 7:30pm.
