First of all, I don't give a rat's ass who is on this board as far as whether or not you're a returning citizen. You paid your dues to society, you shown yourself to be a productive member of society. And that's good enough for me, because the last eight chairpersons have shown nothing but corruption, systemic corruption, and related to the election. I'll choose a returning productive citizen over a lawyer that has proven to have a lack of moral and ethical judgment. So that's the best election I could see. People voted and it was democratic, and it happened. As far as the Human Resources report goes, I demand that this board require that the human resources department report out on those officers that are on the Giglio Bradley list. That's the list that the prosecutor has this term and have been so egregious ly lying, that their testimony could not be taken in the court of law. How many of those officers are there on that list? And why are they on that list? Secondly, the Human Resources report should also show the number and perhaps the badge numbers of those officers that are under suspension. For the general public, we don't know if their suspension really lasted more than a date with or without a and then were their suspensions overturned through arbitration. And so they get their jobs back we know from Dwayne Jones that you can be disciplined and yet still be promoted. The system has got to stop. Thank you.

But I actually came here to make sure that to go on the record to say that all all citizens should be heard without harassment without having legal allegations placed upon them at no time and so any legal matters that's been placed upon the observers should be removed and destroyed drug so I just wanted to go on record safe to say that thank you.
Yeah, yeah, if I may. I heard about reread the letter and we've been listening to you know, various attorneys Attorney John Ra. Concerning this issue, this is something that we take very, very serious and we will be definitely making sure that we look into that to the full extent, you know, and we want to review all body cam as it relates to that because they are legal observers. You know, this is something that has been customarily done. And so definitely, we take that very, very serious.

I am a former officer of the National Lawyers Guild and I was the person. I've been a legal observer now for over 30 years, participating as an attorney and as a legal observer. Representing the rights of protesters in the First Amendment. I was directly involved in the summer of 2020, with then Deputy Chief Dennison at the time when there were legal observers who got wrongfully arrested while doing their jobs. During the summer of 2020. And he and I had a very lengthy conversation about the important role that legal observers have played historically since the 1970s in our country and in this community, and he agreed with me at the time, that was a very important role to be played, and that he assured me once I explained to him the role that legal observers play, that they he would make sure every officer on shift would be advised and informed. Of the little green hats, the baseball hats that we wear as legal observers, and advise his officers to allow these legal observers to do their jobs, and he arranged to have the criminal charges against the legal observer in 2020. Dismissed and I urge you to take whatever action you can take to take a strong position against arresting and stopping and interfering with the important role that legal observers play and have the charges dismissed against the current. I believe there's four or five legal observers from Congresswoman to leaves letter who are now facing charges to be dismissed. Thank you.

The board has to take tangible action itself and remove barriers for those who are taking tangible action around police transparency and accountability. I'll give four examples. Number one, commissioners you requested numerous data and information from DPD that went unfulfilled. On December 21 of last year the board voted to reiterate to the chief that the board still wants to 33 Outstanding Requests fulfill tangible action means following up. Do you know if you've received the data if you have had staff analyzed it and presented it to you in the public in such a way that it transparently informs how you oversee DPD The second is on March 7, the board voted to write a letter to the DOJ demanding an investigation into the killing of 70 year old Darryl Vance. tangible action means following up has the letter been written and sent to the DOJ and if so was the letter made public? Number three on May 23. The board voted to waive the FOIA fees for request number a 24 dash zero to eight submitted by CPT a tangible action means following up did OCI pull the records and if so, did the CPTA received the records? If not, why not? And number four regarding the letter you have from Congresswoman flatly, legal observers must not be targeted by law enforcement as an oversight agency of DPD. Please take tangible action by writing a letter to Corporation Counsel, advising that DPD has overstepped their authority to target and arrest legal observers. And that DPD is evidence should be inadmissible, at least of Corporation Counsel does not heed your request. The judge who hears their cases will have your letter to consider. I also like to bring up the fact that it looks really bad for a city and a state and any police unit if they beat up ticket a harassed legal reservists. I've been involved in a number of protests and have helped to utilize legal reserve as a number of times in the past while during the time I was on the board. There was a times when it appears as if chief Craig especially did not like legal service. You know, we need to make sure that our officers know that legal service as long as they're not blatantly doing anything illegal, have a right to be there and should be respected. In the past. We've had legal service beyond, you know, be the subject of harm from police. Officers. We need to make sure that we are above board and that legal observers are protected in the city. So I think this this board needs to be more aggressively making sure that cases are closed, and they actually researched and closed. You know, it shouldn't take more than 60 days for a complaint to be found and to be resolved. You know, if need be. This board needs to get more investigators. And I think this boy should have at least a percentage of the police department's budget a flat percentage, because as the police department goes up, and there's more and they take on more responsibility, especially dealing with, you know, transportation, the city, complaints are going to keep going up. So you need to do more and start planning ahead and get more investigators to investigate these cases and close these cases. Thank you. Thank you.

But that does not mean that it is the best choice to put someone in a position of authority who has committed the ultimate crime, homicide murder one. That is something that I don't see as something a person should be chair of a board of police commissioners for you know, I personally interviewed at one point to be appointed to fill a vacancy on the PIO PC. So I mean, the idea that someone are they so desperate that they need to dig that deep to put in convicted murderers? I would think that and then the board a majority voting to put a convicted murderer in charge of the board. When we have long time. People without such records. People like Willie Burton, who have been around as long as we've had an elected board he hasn't gotten to be chair. Um, what's up with that? And it just this is a bad look. I mean, there are more there are more immediate matters such as you know, police oversight and the huge backlog of complaints and so forth. But this is just seems like one more bad thing to see happening in the city. Thank you.

Thank you. My name is Shane Howell and I'm a resident of district two. And I want to speak to three things. First, I want to say that it's really important for the Board to take a stand with regard to the protection of legal observers. It's essential that you make clear to the police, that any kind of harassment, or any kind of use of authority against the right of people to protect protests will not be tolerated by you. Secondly, I think you need to understand that the aggression toward legal observers is directly related to the aggression towards protesters. This board has not taken a strong stand to protect the right of people to demonstrate and exercise their First Amendment rights. You have allowed the police to tell you what they're going to do and you need to start telling them what behavior is unacceptable. That leads me to the third conclusion, which is that without a strong statement with you, you are fostering a climate where police feel they can do anything at any time to any one and we have seen this time and again in our city. So I strongly urge you to take the first step by making clear that any actions against legal observers will not be tolerated by you, and you will demand action against any officer who in any way participates in that. And secondly, that you demand action to protect the right to protest in our city. We were built by protest and we need to protect it. Thank you. Thank you,

Yes, thank you, Mr. Chairman. What what I think we should do based on the comments that we've heard today, is that that number one is not just a statement to the Attorney General. It would be a statement to our police department and to the corporation Council, and obviously to the mayor's office. This is a matter of critical importance. We've had a couple of speakers speak about it very, very adroitly, I might add pinpointing the First Amendment issues and the other issues related to this. And I think that our letter should be before we do a letter we should do a policy on on this issue, so that it's very clear and that our position is clear to the community and then we can send it to the Attorney General and everybody else. But this is a an internal policy for the city of Detroit, and a statement based on what happens in the city of Detroit. And we should opine on that through a policy and then a subsequent letter.
Commissioner Yes, I think that we should draft up something strong and to the corporate racing Council, and let them know how that this is very alarming to us and that we want to see the body count footage, you know, as soon as possible, you know, I and to urge our dissatisfaction, this decision making to the corporation count, so we don't need the Attorney General to do our job. We should not shirk our responsibilities as commissioners and we don't even know what's going on with this, you know, so as is we need to be fully abreast and aware to find out what's going on. And if there was some wrongdoing, there, it need to be corrected immediately.
Mr. Hearn, are you willing to amend your amendment to have a letter go to Cooperation Council would you like to keep it the way?
Mr. Chair pro tem? Yes, ma'am. We don't need Commissioner Burton's permission. The commissioner just needs to move to amend what it is she wants to do. And Commissioner Woods if it's to remain can offer a secondary amendment to her amendment if it does not include what you think it needs to include. So what we really need is a motion from Commissioner Bernard about what you want to do, which would be an amendment to the motion made by Commissioner Burton. I
would ask for a friendly amendment Commissioner burden does the employer that we don't ask the corporation council for permission, Commissioner. That's not his role to give us permission to do something. We can adopt policies that are legal, ethical and constitutional on our own. It's not an issue. This is a department of the charities Department issue. So my question to you is, Is it is it permissible to you, Commissioner Burton, for us to within the next two weeks, draft and bring to the board a policy, share that vote share that policy with the community as well regarding the issue of the protection of protesters and legal observers, and then have the board vote that and we send that and then we can publish publicize it for the community as well.
I'll share, parliamentarian again. We don't ask his permission. AMSA. All you have to do Commissioner Bernard to say I move that and then say what it is you want to do. He can't give you permission. I was
thinking that he doesn't have that. Okay, I didn't realize that. Thank you. Thank you for advising me, madam parliamentarian. So that would be my motion to put together a policy the and the protocol was in 14 days because this there's some urgency associated with this. And we can obviously get some assistance from other cities and so forth on this and get get the proper language so we can put some teeth in it. As you pointed out. The Attorney General has nothing to do with what the board of police commissioners does and what policies we adopt. We do that and we can we have the ability to do that and to act on the concerns of our citizens and the citizens in this citizen in this city regarding what they feel to be unconscious unconstitutional of our behavior and harassment. Okay.
So this is the problem. The commissioners motion was to draft the letter. Your amendment is to draft the policy correct. And that's not germane to his motion. So we would have to Mr. Chair, vote on the motion. Made by the commissioner, whether it's voted up or down, Commissioner Bernard can still make what would then be a main motion to draft the policy. But her motion about the policy is not germane to his motion about drafting a letter. They're not necessarily mutually exclusive. But it's really not germane to what he said. So at this point, Mr. Commissioner, Mr. Chair pro tem, we're back to the motion made by Commissioner Burton about drafting a letter. That motion was seconded. It's open to debate, and then you need to vote on whether you're going to adopt it or not. And whatever happens after that, then Commissioner Bernard can make the motion to draft the policy. I do. I want to be clear that it is not the Detroit Police Department's policy to arrest or to properly investigate in the device or do an actual protest. That is not what we do. Just to be clear, talking about the last protest we had in which someone who was arrested who did have a pin number she was not acting as a legal adviser. She just happened to be an attorney who was arrested while interfere. Now we have to look at the other case to the March 2 incident and I'll look at those names as well. But I want to be clear to the board. The department puts it out to our officers, especially those officers who are engaged and monitoring the protest that we are not interfering with the green hats. As a matter of fact, the greens hats make sure that they observe and at some point they assist us to make sure that they tell those individuals to protest correctly. Now I will say if you if a green hat or anybody else in the city commits a crime they're gonna be investigated, and we'll take appropriate action. Just to be clear on that. And the second piece is every officer who wears his uniform takes an oath to uphold the Constitution. And alas, I remember the first amendment was part of the constitution. We will uphold and protect everybody's right to protest. Now, if you gotta lie, we'll do what we need to do. But we always make sure we do that we advise those individuals. So I just want to make sure I put that on record for the chief and for the department. Thank
