The resolution that we prepared was unclear and indicated that the appointment was for the remainder of the term of the outgoing treasurer that that is incorrect. It should be ProCharger through the scheduled special election that council did approve at the last meeting. And so either if the current interim runs or somebody else runs whoever was elected at the special meeting in November they will formally take office once the Wayne County Board of canvassers certifies the election, which is typically a couple of days after the election. So with that, again, I did speak with members of council prior I'm going to ask that council approve the meeting minutes of March 18 2024 with the proposed amendments as requested by the city attorney. So this is the now therefore on page six. the NOC now therefore be it resolved that the Highland Park City Council approves the appointment of Lisa Starsky as city treasurer, until a special election is held, as set forth in Section 18 Four g of the charter and directs the treasurer to undertake all necessary actions to secure the fixed bond prior to assuming any duties as treasurer of the city of Highland Park. that is from a different that was the only was settlement.

first, where it
were a certain limited provisions that one
that provides that there were limited provisions of the settlement agreement had been slightly modified to reflect changes arising from the new trust agreement including the water supply services agreement and wastewater disposal services agreement. So it's providing that there has been a modification to the trust agreement, which was the hang up before and that's when the state retained Clarksville to come in and write rewrite the trust agreement that was presented to you at the March 18 meeting. That council approved and also Glu approved.
Okay, as far as modifications to the waterworks.
Were as you'll see previously entered into an administrative consent order ACO 39906 2017 dated July 28 2017, which require the city to make certain modifications to its waterworks system, which improvements were necessary in order for the city to meet its obligations under the relevant federal and state law. There was a consent order, I assume issued by a federal court that required the city to make modification to its water system is my understanding.

Sure, whereas litigation counsel each approve the terms of the settlement documents, and recommend City Council approve the settlement documents authorize and direct the mayor, the city clerk city treasurer or any person acting in the role of interim or deputy treasurer, the treasurer or any other officers in play attorneys and agents to execute such documents. So the litigation counsel have has approved the proposed settlement documents and it's also directing the clerk treasurer may or whoever else has to execute in order to finalize those documents. You said whoever else well, it was over listed there. So I don't know who else would be required. I assume that's already been done. Those documents have already been executed. Yes.

So so the term for the treasurer and I will say is just to my understanding that that term, was supposed to go until December 31. But you stated to me that it would go a couple of days after the current one of the county they certify that election, or whoever wins would feel the seat immediately from that point.
That's correct. So this is not a new term. This is filling a vacancy of an existing term. So the interim would would be in place until the special election is held in November. And then whoever is victorious at the special election would be formally seated and sworn in. When the Wayne County Board of canvassers certifies the election which can be anywhere from a couple of days to a couple of weeks. It just depends on the situation. I'm guessing and speculating because this is a presidential election. It may take a little bit longer than usual. But it's not it's not until the end of the year. It's simply until the board of canvassers certifies the election.
Which could be at the end of the year.
