It should have never come because certain things downtown wanted to happen. But when it comes to the license plate readers, we know we need police I'll call police in a minute. But the issue is that we just want the DPD to respect the body of the board of police commissioners if you don't know that the surveillance was out and then you come after the fact that's the issue. Also, I wanted to just briefly report and I usually let the mayor know this at the the mayor meetings is that DPD is going to need resources as they approve this marijuana because in Colorado, they are reporting that pregnant women are having babies with small hits, that that research is out there smoking marijuana. The issue is with what the police is gonna have to deal with the burden is the psychosis that they're seeing three kids today are coming in Colorado hospitals with psychosis with cannabis candidate cannabis produced psychosis. So that's the issue cheap that the police department will be dealing with. We're going to also be working making sure we get a we need a mental health hospital in the city and that's something we're going to be pushing the mayor to do. They put money and billion dollars with the tax abatements We want that money to go to hospitals. Thank you very much. This

Good afternoon, commissioners. My name is Brahmas wood dude. I'm an attorney at the ACLU of Michigan. I just wanted to stop by today to address an item that I know has been on the agenda for a little bit of time. At the board, which is automated license plate readers. I wanted to come here to express the ACLU has a deep opposition to the Detroit Police Department's proposed expansion of its use of of license plate readers. We think there are some significant civil liberties concerns regarding data retention data sharing privacy and unwarranted surveillance that I believe it's responsible for this board to take a really deep look at. I understand that the police department has shared a technology specification report with the board and as you're well aware the community input over government surveillance ordinance requires that this board approve that spec report a specification report before it goes to the city council for a vote on the procurement. I would urge this board to take a close look at the specification report. I understand from the agenda. There's an updated report. And so there may be some negotiations between the board and the department regarding its contents. But as it stands, the latest public specification report is woefully inadequate when it comes to addressing civil liberties when it comes to addressing which agencies the department plans and sharing the data it collects with how it plans on destroying the data it collects. It's now planning on using it privacy protections for residents of Detroit of which I am a proud resident. And so I would urge the sport not to vote on whether or not to approve the specification report today. And not to approve it at all before it takes a very close look and works with the department on generating a more robust and protective specification report before this goes to a vote at the City Council. Good afternoon board. Good afternoon. I administer Eric blood from Sacred Heart Catholic Church here in Detroit. Trying to help this board correct itself is it's just exhausting. I mean, if we just look at the agenda, it's something about crime. No one has ever said how crime relates to police officer misconduct. I just don't know where it fits in unless you think that some level of crime is justified some level of police officer misconduct. I just don't get it. With this surveillance. This department has been so clumsy and so irresponsible with surveillance. No one should trust you with anything else. facial recognition technology for the last five years those weekly reports revealed that 100% of the people identified and used by facial recognition technology are black people. 93% of them are male with ShotSpotter. The weekly reports even this year's year to date report says 17,000 shots were detected but only 42 guns were recovered. I mean you can't find an NBA basketball team with a shot record like that. And then last week, someone brought up a good question about the license plates reader. If a car was stolen, you identified in the license plates reader the car is recovered and then the owner starts using that car again. When are the records updated? When is that owner who recovered their car no longer in danger of being arrested, detained for days. Thank you

Good afternoon, commissioners. My name is Bob Carmack and I've been here before and when I came here and so forth, they sent me to see some internal affairs people. These internal affairs people asked me a bunch of questions. After these STS questions, I felt they were investigating me. So you know this young guy that's doing the essay questions supposed to be tried to help me. I started recording him. Situation is that, you know, you're trying to get me I'm gonna get you. And that's why this. I told him. This officer is a captain now was a lieutenant. I told him four times she's planted evidence for a false arrest. She meets with the mayor every two weeks and so forth. I want subpoena power. I want you to subpoena this guy. I want you to subpoena what happened me. I need a detective to investigate the charges that were brought on me falsely the abuse of power, boss arrest and so forth. You have subpoena power, correct. Let's investigate this. That's what I'm asking to be done. The situation is it the leadership of the police department, which is Chief white, but he answers to Mayor Duggan, that ain't cheap white is the leadership of the mayor's office. Once the mayor office authorize a fosse Warren, who meets with him twice a week I think or twice every two weeks. That person needs to come in here and answer questions. Whatever this she had support. She had no evidence, no witness, no documents and got a prosecutor to sign a warrant. This sane American This is illegal. Oh, wow. Yeah. So good afternoon. And as you can see the folks who come down here every day or every week. We all have other stuff to do. All of us have jobs and other concerns. But we know how important this board is and you're not standing up to your obligations. We are not getting the bang for our buck here. And every week you ask us what you should be doing. I'm going to tell you again your job. First of all, everybody on that board should have a problem. With Detroit being the most surveilled city in this country. Because it's the blackest city. We've all come out of slavery. We won't come out of Jim Crow. We will come out of the war on drugs. And black folks have been most clicked upon. What just came out of COVID What we saw the difference in the health disparities. And yet you think being black is the problem because guess what this over surveillance leads. It doesn't stop crimes. It doesn't prevent crimes. It just oppresses black people more, which means you all are in black face. Yeah, you got black faces. You don't have black minds, because you continue to do what you do. to us and say a follow up phone. Nobody wants cry. But crap happens in Lavonia West Bloomfield, they're not over surveil white folks do all the mass shootings. But you black people are the overseers do your jobs.

Keep that in committee until the policy committee has thoroughly worked out a solid policy regarding those readers. There shouldn't be any vote to approve anything, unless you have a firm policy and plenty of issues were brought up at that last meeting. Some of them by Commissioner Burt brought up some very good points regarding civil liberties and privacy. It's not a trivial matter. Um, secondly, I also wanted to point out that for those who hadn't been watching the news or weren't watching the station where it was reported, um, since the last meeting, we've had the surgeon once a corporal Dwaine Jones got a slap on the wrist he literally got one day probation Okay, made it into three days probation because it was on a weekend for beating up Shelby Smith over at receiving hospital. So that's what we got going on here. So what I nursing I'm going to say is, it's a long ways off until you got another contract to negotiate it dropped the ball this last time around, get involved. pass resolutions, talk to people make advisory decisions. Be thorough. And do what you can to make sure the next contract is not have the arbitration loophole whereby officers can avoid promotions I've met some people been getting promoted. You got some great people there. But once in a while the board of police commissioners needs to say no. And they need to have that authority. Thank you for your time.

Make sure that doesn't happen again. Also, I think that Willie Burton I'm the Policy Committee did an excellent job of having people come in and give pertinent information. I think that this boy should get pertinent information to the community. Also, I think this board needs to be a little bit more balanced as relates to policies and procedures. You know, you need to have opposing views or different views, not just listen to one side. Also a number of people have been asking me about so much that the pandemic is over and you back into having community meetings, when you're gonna start back having food into community meetings that used to be a standard staple. In fact, when I was doing that, there wasn't as many people to dislike so many. There's a whole lot of work that needs to be done. And I think if you're trying to be a little bit more honest and more straightforward, and work for the people, your numbers might go up as it stands right now. I really believe being a community activist and countless of citizens that I've been able to help license plate readers has really been pretty, pretty helpful for me and behalf of the the cars that I have found. So as we know we have an epidemic of stolen cars here within our city. Every night, east and west we have multiple cars that are being stolen and because of the license plate readers and criminals do not remove license plates off of cars are how we're able to be able to find if the cars are east or west. And I don't think that it's more so oversight of the citizens or harassment of the community but more so even if an Amber Alert you need to be able to have a license plate to be able to know who you're looking for, as well as the incident that happened with a female who was kidnapped from Ohio and was brought here in borderline Detroit Dearborn where Dearborn officers fatally wounded her but it was because of her license plate in the readers that picked it up to know that she was here in Michigan. And I really believe that is not more so a harassment or a racist issue is really helpful. And I think that people need to look at it differently because this is one way that we're narrowing down once again, criminals and narrowing down beds of cars, locating them. Thank you. Thank you,

Alright, I got noon. I'm also calling I suppose in reference to the license plate meter policy on a few different points. So firstly, I'd like to voice my opposition to the police department's proposed policy, and in particular to their spec report. I believe that, as we heard in the policy committee meeting last week from the ACLU representative, the Detroit Police Department just isn't doing good work here to actually vet the surveillance technology that they're preparing to deploy against citizens. And we've just heard from the last speaker that the deployment of these ineffective surveillance technologies can have real and deadly consequences. When we like use this ineffective technology, the splot technology and to tell officers Hey, this car is stolen when in fact the leader is simply miss reading the plate. We end up with officers going in guns blazing. When we just tell them this car is stolen, no other context which is all you can get from the license plate reader and then even if the car is actually stolen, you end up with tragic cases like officers going in and guns blazing and, and killing or seriously injuring innocent people who might be in that car. I'd like to further stress that the problem here isn't just that the technology is bad. It's that the DPD hasn't done its legally required due diligence to review the technology and make sure that it's actually safe. For that reason I back any motion to reject the spec report from the DPB Lastly, I'd like to simply thank Commissioner Burton for looping the ACLU in on on this on ShotSpotter and other issues in the policy committee. I'd like to remind the board ad nauseam get again, but you don't work for the police department, you work for the people of Detroit. I recognize there may be personal differences between commissioners, but that's never an excuse to simply not show up the policy committee. So I'm not the policy committee and passing things through the policy committee is the job that you are elected to do and that's not something that you can just pass off onto staff and revert back into rubber stamps. Thank you. My name is Peter Blackmer. I'm a resident of district one and also a professor of African American Studies at Eastern Michigan University. I'm calling today in regards to the spec report for the automated license plate readers based on many years of studying police surveillance, particularly police surveillance technologies like license plate readers, ShotSpotter Project Greenlight, so on and so forth. I have a lot of concerns about not just the spec report, but more generally about our priorities in this city when it comes to addressing property crime, harm and violence. I think that our priorities here are skewed towards punishing those who commit crimes instead of resolving root causes to address why crimes like auto theft are being committed in the first place. And we are allocating our resources in ways that are designed towards punishing people rather than resolving the root causes that lead towards the kinds of actions that we are proposing to resolve. Furthermore, the spec report that has been presented is too broad in a sense that it gives great discretionary power to the Detroit Police Department that is ripe for abuse. One line in particular, other legitimate law enforcement purposes is a catch all that allows the Troy police department to use this and other technologies any way that they see fit, which historically has been ripe for abuse, particularly against poor and working class black and brown communities and those who are politically active in the city.

So if you remember a couple of weeks ago, I kept saying I wanted to have public comment to hear from you guys. That's what I want to do. Alright. The level of disrespect that I heard and saw last week was appalling. Especially from people that call self leaders. I just it was it was something it was something to behold. One good bright spot came out of that is the Zoom audience couldn't hear it all the back and forth chatter. They say they didn't hear. They say they heard me ask over and over. Please give respect. And that's all I've been asking since day one. I sat on this board is a respect. That's all I've asked. It's a respect one another. We can all be hurt. My father always told me, Don't scream and holler. Make Your Case better. And that's what I tried to do. Try to make my case better. Now we all not going to agree on everything. All right. license plate readers. I noticed a hot topic just like facial recognition was right. I'm looking at the license plate readers. I'm like, okay. They're asking citizens what we're gonna do about crime. The police are telling us this is what's happening to the crime. If we had this too, we might be able to slow some of this crime down. And for the disrespect I've been seeing. I didn't see any of that from from MSP. They put their heads up and not a peep. I hear nothing. No protests, nothing. They put their hands up like in a nothing I got one write down where I'm at. So I'm saying if that's if that's not going to be the cure, which is not right. But if it's a tool and the police needs that too, it's up to this body to make sure they use that tool right. And if they don't use the tool, right, that's what we're here for. But put stuff in place to make sure they do. Often I understand is a tool has been in place for nine and it has not been abused yet. So I gotta say my hat's off to them. We can start a precedent right here. If other cities are doing it wrong, that's on them. But if DPD and Detroit gets it right, maybe they can modeled himself after us. Maybe they can but what I do want to hear is dually readers. If we catch your car, you won't show us a go down. I don't want that. Right. If we we use the license plate readers wrong. We get fine. Where does that money go? Homeowners go? I don't know. We're going outside the box. We have to because you know the next thing that's gonna be and I don't see no difference between a drone and a helicopter. I just don't other than the cost of that helicopter cost a lot of money. And that drone does the same things. A helicopter does the same exact thing. So that's going to be next. But my thing is, is always anybody can say no. No is the only two letters in the alphabet that spelled right next to each other. No, no. What is your solution? How can we get to a yes. Now we're in negotiations on a back and forth from the license plate readers right. To the little bit of what Commissioner Burton said. I took a look at what Commissioner Moore said. And we've gathered and we're ready to to unveil some of that. And when we can but we're listening to people. And that's how we can get things done. The to just say no on something and you don't have a solution to fix a problem that we all face it. That's not fair for everybody. And we just can't let five people dictate on what's going to happen to the city of Detroit. We just can't. That's not fair. Not fair at all. I want to hear from all sides. The ACLU I hear you data we don't want what is the solution? How can we okay, this will work but that won't if you tweak this weekend except that how can we get to that point? And that's what this board is trying to do. How can we get to that point? Because I'm being honest with you. I'm just gonna say we got to do something this crime is getting out of hand and the summer is just beginning. It is getting out of hand. That is my report. Chief.
I'd like to start with the topic of the hour and that's LPRs Let me begin by explaining what we're trying to accomplish. The DPD currently 85 CR cameras 410 Mobile LPR cameras and three trailers but LPR cameras on we currently already have them. Let me repeat. We already have them. And we have had them since 2018. Okay DPD is using this technology. The cameras have been have played a crucial role in helping to DPD solve crimes ranging from auto theft to smash and grabs to homicides, to elderly people who lose their way and are driving around. A family member calls and says I haven't seen my grandmother, my grandfather. This is your plate number. We put it in we can tell what the plate hit are over there. We pull them over we return them home we've also used them to solve homicides, kidnappings, heaps to track the path of escape on many crimes in our since 2018. Because of the success of them. We said what if we had more plate readers because we are now up and auto theft by some 30% people working class folk who get up every morning, look out the front door and see that their car's not there. It's calling my office and saying what are you doing about all of that? I sat down with my team and said what if we were able to know where the car is where the car is being dumped? Where it's being stripped? have cars over there because all the areas that are dumping the strip the cards have been guards stolen and put it in the LPR system and see if it hits here we'll have a car near we may be able to stop them before they strip it. Return into cars getting people back pole again not having to pay exorbitant tow fees but more importantly they have Detroit auto insurance rates in the United States of America. Beyond that, as we've already talked about. A number of communities use these plate readers including the Michigan State Police on the freeways and have been very helpful again in freeway shootings, identifying the routes of escape. The DPD operates from a policy that has been in place since 2016. We thank the board for the support and approval on an 18. I'm happy to report that there has been not a single confirmed case of misuse of these devices. So with that informing the decision and opportunities to use them in a more expensive way relief to keep people from being hurt and having suspects suspects escape, only to commit the crime again because most times they're not going to just stop and as it was brought up earlier that we are focused on catching those offenders who commit crime. That is one of the few things I heard that are that factually correct. And some of the presentations that are heard about this. We are we are committed unapologetically to getting people off the street who raped Rob is going to apologize for that. We recognize that there are root causes. We've spoken about this, about the mental health piece job opportunities, and I'm excited that we've got a number of programs, whether it's whether it's jobs, whether it's it's shot stoppers and other programs that promise to be very impactful. But my lane, what I'm measured on is the ability to reduce crime in the city and allow folks to be able to enjoy our city as they should and not be a victim of crime. My job is to make sure that there's no more people kidnapped off the street when they leave work and murdered. My job is everything I can doctors are murdered in their homes. Kids are shot and raped. And I need to have every right to make sure that when a criminal mixer does crime manatee it's a bad option and they have a risk. So after careful consideration informed by data, the department myself my team decided to use a portion of our American rescue plan dollars a portion to further the investment in LPR technology. The proposed purchase would allow for an additional cameras needed to outfit up to add additional intersections throughout the entire city or city. All over town the question that naturally arises are we here for procurement matter? It's we're here. So has of transparency and respect for this process in this board. Now before anyone says no, Chief, you're here because you have to be no. Let me explain why. In 2020 the Detroit City Council passed an ordinance called CX we participated in that we we gave input we sat down with Madam President, oh current president and work through the rules and agreed wasn't imposed on us we agreed to participate in a community of government use of surveillance CX and we agree that any purchase from this point forward CX would apply. I've spoken several times about the fact that we purchased these in 2018. The ordinance governs the procurement that had not been received prior to to the approval of the ordinance. Very important moment right now. We already have it. Okay. We can buy it. What we're asking is to be more transparent, activate an ordinance that we don't have a legal obligation to activate and share this process with the community and allow for the dialogue that we're having right now. But despite this legal technicality, the technicality and it is a technicality, right that we don't have to but to eliminate all doubt that we're trying to do something improper or against the grain of what we've established with our community. I've heard to take in accordance with the CX ordinance. I've directed my Chief of Staff. We're going to follow CX even though it doesn't have quarterly weeks ago. The chief of staff prepared an eight LPR specification specificall struggling early like you informed by personnel within the department. It's your my directive and transmitted to this board. We've had dialogue with your staff. We've looked at some changes that this board has recommended we adopted most of those changes or many of those changes. And for that very reason, is why we decided to hear to the to the CX ordinance. We want the dialogue we were asking for the dialogue. Should the Board approve the specification report today the document will be posted on the city's website. So this is not an all or nothing proposition. This is the first part of the execution of the ordinance that doesn't apply. So by the by virtue of us saying yes, go forward. We now go post on the city's website as required by the ordinance. We won't come back out of it and say well, we're not going to follow the ordinance. Now. We're going to follow the ordinance on record. This will give the public an opportunity to voice your concerns. And to be heard. This is the beginning of that process. This isn't the all inclusive process. During this time the department will begin doing its work. The work will include community meetings such as we had with ShotSpotter and at least one more public hearing will be held. The team will be speaking to the city council members and their staff during this time to answer any questions that they may have. And then finally, it will go for a vote. The department's track record with LPRs has been strong. I've said that at nauseam since 2018. As I indicated there is no evidence that this data has been unlawfully access or unlawfully use or misuse is being discussed today only because we brought a specification report to the board as part of our most recent effort to be transparent. Any concerns over privacy that have been expressed are large part theoretical. We've already have the data. We already been using the data. We have not misused the data. There's no expectation of privacy on a license plate. And I've said that enough. And DPD does not misuse the data. But if someone does this in the in the report that we provide to this board weakly was accused of this. We will provide his board with a disposition and the board will have complete transparency on the issue and the ability to question publicly what happened with the officer who was accused of that Act. There is no remedy other than termination for misuse of data that results in someone's arrest or prosecution. Weighing the observation against value that is brought to our department is very important in solving crimes. With the use of technology we were able to give families closure closure you know it's interesting, we have a very rigid, very rigid
facial recognition policy. We have very rigid policy regarding when will it be used part one crime only and it's only an investigative tool that the second investigator has to see exactly what without being influenced by your part of the investigation. So independently, we arrive at the same place after the fresh facial recognition, positive hit, then that just launches the investigation. You don't go make an arrest based on that you do investigation saying this is a potential suspect based on these two two people. What's interesting is when we change that policy with this board's assistance a couple years back and we went to you know murder, rape, robbery and home invasion one meaning not home invasion two but home invasion one meaning someone broken our home, and we were there because that's a likelihood of someone being hurt. If someone makes that decision and they know your home. They're probably going to hurt you if they find you on your own. And that's it. We don't move from that we have had come on the other side. When people have pictures of someone breaking in their home. Why won't you use facial recognition technology to apprehend them? For one reason only. When is your loved one when who got off? of work? Like at seven o'clock in the morning, she's kidnapped. You want the police to have every single tool to find her or him and hold the person accountable. And if there's misuse of the tool. The accountability is with the chief and the officer in question. But you don't tie the hands of the department and prevent them from investigating crime out of fear. Use you have ability which is what this board is based on. And if someone makes that to sit Oh hold them accountable. You hold me accountable because I'm not Fibby chief but we cannot sit in a town where murder and its attempt commonplace. And as I moved by, yes sounds 7% in homicides, but I'm not going to pull my shoulder I'll patting myself on the back. Because all that means is last year this time. I had 95 people dead in Detroit at the same time as opposed to 88. So for those 88 families, they don't want to hear the chief of police celebrate a 7% reduction because that means nothing in their living room. That means nothing to that mother who has to bury her daughter next week because she was murdered means nothing that I'm talking about a 7% reduction, non fatal shootings, we got a 1% reduction 266 People in 2022 were shot at this time 263 As of murder to African American males under the age of so we'll be investigating that so these numbers will be slightly up next week. 263 people were shot and the problem is I'm failings in our community, as if it's not so bad. Little shooting as a failed murder. They didn't shoot him thinking he wasn't going to be dead. So that's 263 More times people could have died 263 more people in our community. We have a 2% uptick in in robberies, but we headed in the right direction. We see our numbers that are starting to come down and I think it's a lot of our strategy. But still that's 492 Robert not a lot offer king. The officers deer already have responded to 1165 mental 914 mental arm runs suicide and progress 519 Five under 19 suicide progress suicide threats 1055 for grand total 5328 runs since January 1 of 2023. I'm gonna give you a couple of incidents and I'll take any questions that you have a death investigation suicide occurred may 13 2023. Officers were dispatched to 20,000 block of Goddard to investigate a call for service. He was he was in crisis armed officers arrived at the scene and spoke to the victim's mother who stated that the victim suffered from schizophrenia and was bipolar that the victim was walking dekat and armed with a gun. Officers from the crisis intervention team arrived to assist officers tried to convince the victim who at that time had entered the home after walking up the street to come out of the home so that they can get some assistance, but the victim refused to leave the location. Officers heard a loud gunshot and breaking glass and the family members screaming and unfortunately, this person who was in crisis committed suicide. On May 13 2023, officers responded to the 40 212 San Antonio Detroit receiving hospital case that we all know sadly all too well. To investigate a call for kitten officers arrived at that location spoke to say that they production that there was a person with a obvious wig who was male, very long, red wig. We also were able to validate that on video from the hospital. Officers review the video they are able to see that the suspect follows our victim into her car pushes her over in the car you hear four gunshots and he takes off at that time working with a number of different agencies, Novi PD Michigan State Police partners, we were able to track her vehicle. The vehicle was recovered in November sadly she was inside it. But we have some pending charges on our set from a previous violent situation he was involved in and other charges for narcotics and weapons possession that we're holding that they are holding him on now. We are continuing our investigation. We're working with the prosecutor's office they provided us a lot of feedback on on what they need from us and we've got a good team working on this case of bring some closure to this family. And we're confident that this suspect is in fact good for this murder. A brilliant young nine years a whole lot ahead of her a mom and it's violent person who's who at one point in her life thought she thought her way guilty. It's a very tragic situation but I'm confident we'll be enclosure very soon. On an up note just to close out and take questions. We did our our walk them out Wednesday, great turnout and the third precinct yesterday. And as you talked about Chairman, the woman in blue was hosted today. It was a fantastic event Patti kukula. and her team did an amazing job. We awarded Rhonda white no relation who's an outstanding detective from the fifth precinct on award for my apology and that is it. I will take any questions at this

chief you know how many readers scout cars with DPD right now and and how many you know, how many how many incidents where residents in the black and brown community here in Detroit? Say that, you know, felt that they were profiled because of an officer in a scout car and their license plate readers.
I don't have a correlation between license plate readers and profile complaints. Any profile complaints would obviously come out of the body that you oversee with the Office of Chief Investigator but I don't find a correlation between those two. Remember the license plate reader is is a much improved version of the the old school hot sheet where when a car is stolen, we get a sheet of paper that has a listing of those cars and officers would drive through the neighborhoods and look for those plate numbers. What the license plate reader does if a vehicle is stolen, who's worn it or if it's a missing person, or the vehicle is missing and was an elderly person who was at risk and we put the vehicle in the system they the vehicle or that person's loved license plate reader hits. It will tell us that that's the car and then we would just pull it over and investigate. So they're really profiling and that in that aspect. We're actually just responding to the information from a complainant that we put into the system. And then we will just stop based on that information that we received from that third party
chief. I don't think you answered the question but how many likes and plate readers are currently on scout cars on on your scout cars DPD Scout
a large number but I don't have the What's that number gonna read them to you again, it'll be the same numbers I gave you earlier, but I'll read them again. I don't have a breakout for the scars. But if you'd like for me to repeat the numbers I'd be more than happy to.
I like to note we'd like to know how many likes late readers are on our scout cars on your fleet. Can you provide that tours at a later date do
that but it will be broken down out of the 110 number that I gave you. They're not all one scars, but some of them are
there.

I don't understand that because how would you know? How would that work? Well, we can get into that a side conversation. That would absolutely be the most ineffective way to use a license plate reader.

Thank you, sir, through the chair. As I've sat here for several years in this point, have always appreciated your transparency. I've always appreciated. Don't shy away from important topics and you don't shy away from the criticism that this body gives you and I also appreciate my colleagues on the board in the back and forth that has been going on as it relates to this policy and how we might prove it. With that said I have one question and a subset of that question. I've received several inquiries in in regards to immigration. So could you number one, reiterate the stance that DVD overall has on immigration? And number two, the sub question being when it comes to data availability and access from immigration agencies. Will that be the case with license plate readers?
No, it will not be and it's totally a policy. We don't do immigration enforcement. We have a policy or any interest or intersectionality of immigration and policing. If there is no warrant, you can't call us and ask us to investigate someone's immigration status and the plate readers populate it for murder as a term suspect that's one at stolen vehicles, as well as, as an indicator goes high risk incidents were for elderly that are missing and things like that. But no immigration would be absolutely against our policy to populate the field for a plate reader for that.
Thank you second question, if I could or rather comment I would love to have and it's not specific to LPRs but just in general, especially with Commander holder bomb over at Fourth Precinct. I'd love to have a forum in Spanish or bilingual rather, in particular to be able to cover a variety of topics, the rise of summer, obviously, just to be able to address a lot of those concerns that exist. And it doesn't have to be obviously specific to Spanish. We have a lot of folks who who speak a variety of languages and throughout the city of Detroit and in particular in the Fourth Precinct area. I'd love to partner on that.
We're more than happy to do and again, I just want to reiterate Commissioner. We've had him since 2018. And there's been no instances of that and there will not be going forward

So what type of positives does it we know it's got some accuracy. But then what type of negatives does it have? Can you can you tell us about that Chief?
Well as the chief of police in a city that has the type of numbers that we see I don't I don't, I don't see negative I see that you have to have strong policy. And you have to help people like the positives or we can identify people with committed crime the route of escape, we can quickly or quicker or more efficiently I should say, identify where those vehicles are hitting if someone has been kidnapped. If someone has been forced in a vehicle and they hit a license plate reader, then we're able to see and get into that area. So I believe that the positives are, you know, are well documented. I characterize a negative I think there are some who fear technology and are very concerned about its misuse and forms will alleviate some of that. But there'll still be some mistrust. Now, it's that's why you have to have
right right, what tape went out when I say when you spoke on the positives desk. Good, great job. Now when I speak on the negatives, is it always accurate is it 100% accurate, or is there some inaccuracy? You spoke on the positives. Now speaking, when I say the negatives, what about the is there any inaccuracy?
I can't speak to an accuracy or negative from that standpoint. We're talking about police officers on a vehicle. If you look at if it hits on 123, ABC, you've responsible for looking up and making sure you get you know 123 ABC or ABC 123. You have to make sure that you as a police officer continued investigation. You don't invert the numbers you and if you it's hitting on what put in the system and for what the vehicle is right. And so when you see that pop up, you know, you still have investigative responsibility, but that's no different than you had prior to the license plate reader. If you you got a hot sheet a piece of paper you miss read it, you have to make sure when you pull that vehicle over, that you do the appropriate inspection that you've pulled over the right car. Yes. Before we move on, if you commissioned to look in your binders in your packets as specification, report for the LPR technology, and it has a lot of questions and answers in here and the purpose and everything so that's the chair I have a
question Commissioner.
informality of this state because I noticed this serie mad because what you fresh is diff she got the you look clean today, sir. So my question is regards to, obviously license plate reader and you know, I've had several conversations that have, you know, comforted me but for the sake of the public, I know that one of the challenges is the retention of the data that are received from these license plate readers, and there is a desire to have them to be quickly eliminated. If they are of no incident or investigation. But it's my understanding that it's needed to be at least 30 days and so I just want to give you the opportunity to kind of communicate to us why that timeframe is necessary.
And we have probably one of the robust schedules on on purging, right there are some agencies that keep it much longer year. And the reason for that is you don't what if you don't know the murder happened, right. And if you say that you find a body and you get a you get somebody on the ring doorbell for example, when you say you have a car, right and then now you need to identify with a car when maybe you don't find that out for a couple of days. So you need to have the data and we said you know 30 days is the least amount of time so that we can track the vehicle if the vehicle should come up, but you're talking about hundreds and hundreds and hundreds and hundreds and hundreds of vehicles that hit the that are in the system. That hit this thing, right. So it's not like no one's going to have even the time to sit there and individualize each of those vehicles. It becomes a population that you're looking for. The crime is think of the hundreds and hundreds of cars that are on the street at any given. Those are passing. You're passing it right now all over the communities, not just Detroit all over, right? If no crime is committed, if no one is robbed, if no car is stolen, you may let's say you're on vacation, you come home, your car's gone. And now we can go into the system and say well, in the past 30 days it hit here hit there, as opposed to the moment it hits, there's no incident eliminated information, it would be almost as if it didn't hit because you have to capture it to be able to track it to be able to profile where the vehicle is if there should be an incident. I think the misconception is that someone is taking your individual plate number and so Uber focused on it and concentrating on it, that they're tracking your whereabouts. That's not what it is at all. Every vehicle that passes the plate reader every right now there's someone driving past a police officer in one community, some community, not just Detroit that's hitting a plate reader. And at some point they're going to purge the information. But if there's a robbery, or a murderer, or something that causes them to access the plate, they'll be able to see that it hit the hit the reader, not the other way around. They're not car first. It's it's something happened involving this plate. Now you go in and you see all the things today in the life of the plate. And but it's nobody sitting there focused on your plate. It's it's there. If it comes up for 30 days in Detroit, if it doesn't come up 30 days in one minute it purchase. So
you know stating their spectrum that that exists, you know that we are more conservative than other agency might be? Do you think that that estimated time when it was 30 to 90 days?
I believe it is I don't have the

conservative? Or is it a situation where there might be some investigation where 120 days would be more appropriate? Are you being conservative at this 30 to 90 days,
we're being extremely conservative. Frankly, I'd like to see a four year but I know that that's not something that people will I think that that will have some some greater concerns, because we'd like to be able to find out what happened and when it happened for as long as we possibly can. So what we talked about was looking at extreme case and C's, which were indefinitely, and they don't and then some agencies that didn't release them, and then some agencies were around the 90 day 220 day mark and we said well 30 think that that gives us the best opportunity but again, I just want people to remove from their minds. Does Uber focus on their plate from the standpoint of if it doesn't come up in anything? It's not up is just hitting a plate reader. You probably hit a plate reader some community in the last 24 hours and you don't even know it and not just Detroit, right but and as long as you don't report your car stolen or something, you know, I'm willing to put that in the atmosphere but you don't have a need to report anything with your plate. There's no need to research where it hit.
Thank you chair. One last question, please. And this one is again another concern that I think that the community has, and that's around who sees the data, and I read some data elements with other agencies and while Detroiters may have great confidence and trust in you, chief when it comes to other law enforcement agencies and area probably not so much can you explain how that agreement works? How other agents are able to be in what are their circumstances that their data is shared?
So there's data sharing agreements and law enforcement across the landscape. Right and, and across the landscape. Okay, so we share information back and forth. There's no There's no perimeters around looking for the person who just killed Rob rate shot at somebody we are doing it constitutionally, but we're information sharing, there is no expectation of privacy on a plate. So if you said to me, I was robbed by car ABC 123 We run it does that know and we share it with every single agency if Farmington Hills, Michigan State Police and state police to say hey, ABC 123 shot somebody at x street we think they hit the freeway. They're going to run it and provide us with always been that way though. So that part is the same but again I go back if the car is wanted, we share information. Otherwise we wouldn't have a need to because they would say if we have a missing by the way, and we if we will call these other agencies and say look 123 ABC has a missing person in it. Have you seen it? Let me check our plate readers. That's how it works. And they will do the same for us and we're going to do that. And I'm not going to apologize for that. I'm not giving criminals a head start. I'm not giving criminals are here to kill rate robbery league women and trunks. So we're going to do it constitutionally. And so to do that, if it doesn't come up, if we're not going to randomly say Hey, can you can you run your there's your plate if I want to run it, we could run it but if we run it for no reason that's illegal. Run your plate. Where were those things? Dang as we drive up and down the street, and to Commissioner Burton's question with the cars that habit enum Ding ding ding ding ding as you run by right? This is hitting plates. It's no reason to pull them over. You're getting hundreds of plates, but the time it comes up as stolen. Yes, you're going to pull them over. Want it for murder? Yes. We're going to pull them over.

Fine. The same thing is is I'm on right? I'll see i 90 days to and before and then that's a bonus for us. I mean, he's got a really good job or it came to the rise that it was basically nothing. So thank you for being transparent and bringing this to the board for this kind of discussion. I've had several conversations over the past couple of weeks with different people, some for some against the license plate readers, and but the common commonality of most of them is that people think about their nieces, their nephews, any victims that they know and solving crimes that that happened to them. So I think that people want to use every resource available within the constitutional confines that you have. Um, my question to you is, do you have numbers on or data on how many crimes have been solved, solved as a result of using the license plate reader through the
chair? I don't have them with me, but I can provide that to you. We do a lot of legwork on that if we have a couple of weeks because we'll have to literally read at the plate reader led to right. So give me a couple of weeks. Okay. All right. Thank you.

I do recall sitting in her office with Mr. Hicks, Miss White, and of course, President Pro Tem but see because facial recognition was the rave I got somewhat confused as to we're in President Pro tems office and then you know, we pitch well. border police commissioners created 2019 facial or facial recognition policy that's tight. And that incident that happened in 2018 I knew had no bearing on what it was we had already the OPC had already put in place as it relates to facial recognition and policy. So when CEUs came on board and 2021 I became really sad and records will show citizens came out in great support of that ordinance. Now we had a presentation at the policy meeting prior to the bo PC meeting on that thirst and a young man also that evening came to the mic and gave Aereo whereby the CRS ordinance was announced and it and while the scripted that was used, the CRS does not have any teeth. So kind of concern as to and I heard you mentioned how you will ensure that your law enforcement members are not when I have every belief that you will, will meet a strict reprimand or whatever if they were caught to violate the license plate reader. Then could you perhaps help me better understand how is it then it was alleged that this was challenged and was not supported in the way that I'm sure citizens were thinking it will have having it to be used against our law enforcers
to the chair I I think he I wasn't present for his commentary. I'd have to explore that a little bit more I think CX is probably one of the cleanest and most I mean black and white ordinances that there is there's there's no fluffy language in it. It either applies or doesn't. And you can't even take it before counsel for purchase. If CX applies without having done the CX work in the CX work is this. And it's also community there's like I talked about earlier, there's another layer like this isn't over. This just begins and we have to go before a public hearing and let everyone come in and talk about this. From all over the community there. Has to be a public posting and then you provide the council board with the results of that meeting that occurred. Many of them will participate and then before it can even go to purchase and they approved the dollar for it. All those documents have to be attached so I don't understand how he characterizes it as a toothless ordinance, because it has I mean, it's a very effective ordinance you have to do these things. There's no way for you to advance pass any step without checking every box

Well, I think that that's a great example of what it will look like in the next next phase of this process. But, you know, it'd be easy for me to try to do that, but I won't do that. Because that's not it. You have to approve it first. Then it goes to that public hearing. We can't conflate it and say, Well, that was the public hearing. There has to be an actual public hearing. That was your meeting. Where there was some people in disagreement.

People like a CL, ACLU, do you have opportunity to this sort of like the gym to legitimize the community and stuff like that if there's any way that you have a conversation with them in regards to the pros or cons, for example, in here was also some things that they hated when I went through it, that things that they were thinking to protect the privacy of citizens and so forth. On the nation visa, your chief that you did look at this and some of this stuff you did. You didn't recognize that
we need to deal with it. You know, we have very strong policy and existence already. Those things that we identified as opportunities to improve we took advantage of that, but but we already have policy that this board has approved, that is very strong. And what it all comes down to is accountability. It's difficult to look at constant hypotheticals in every scenario. You said you just have to have four corners strong policy, and hold people to it with regards to you know, the policies themselves. Remember that there's a data sharing agreement, there's a policy on this use to all these policies are in

In terms of there was a in the document I read that about 2000 information photo where 2000 firms have something will be, oh, we shared data. It was rolled up last week. So I had to go into this and tried to find it with the Secretary of Health. We found it but I want to make sure the community knows we're not sharing this. You have to meet data with firms to country or any thing
like that and you say they don't really I can say on a record we're not we're not in the business. of sharing personal information that this information that enforcement
purposes only, sir, right. And that's when you say and we talked about all law enforcement may become necessary in the neighborhood.
Dump across the country, right law enforcement costs to con immigration, not private entity, law enforcement.
So finally, thank you for your patience with me. You keep what you say. So why do you need a vote here? And then why you need a vote from City Council. If everything is already you go to your presentation. Is that very humbled by it admitted I thought you would go go up there but she went very humble about it and I really appreciate that it's caliber and vote mass and what you need for City Council in order you already got the money identify. You got the equipment. You You got a policy from us already. What do you do you go and get more information from the community? You missed a word you ask, Are you missing a word called boat? So why not just put it out there? Why not tell you that this is what we want to do? Why not have these discussions with the community and hear from them there? If they don't like it? It's still part of the process. So what I need is a vote so that we can move forward with the public hearing, okay, with counsel, and all of those pieces. So this is the beginning. So if CX apply let's pretend for one second that this is just a new purchase. We don't have them. This is brand new, there's no no purchase CX applies then we would need your vote to move it forward for the public hearing and the start to process because we need you today. Or whenever you decide to take this matter up

Good afternoon to these to this honorable body. And thank you again for the opportunity to to present we want to talk just a little bit this afternoon about the process of our new hires who have come in on May the first we receive five new hires, and just want to give you an update on their training. Our five new hires have been trained by acting supervising investigator the Sonia Sloane. Who's here in the audience with us today. And she actually wrote the training curriculum and developed it. She's also asked several of our senior investigators to participate as well as supervising investigator Ainsley Ainsley Cromwell, senior investigator Elgin Murphy, senior investigator, Justice Jessica Hunter, senior investigator at revair, senior investigator, Hiller, senior investigator steward and senior investigator culture. And so all of that part to play in making sure that they share their experience and training these new investigators. I'm going over just a small part of the training that they threw No way can I depict for you all of the training that they've had, but here's just a sampling. Certainly they've had an introduction to the current staff members a tour of the building, our general office offices, and procedures within that office. They've signed obviously their onboard documents. They have obtained login information, set up their email their database mapping, which is a huge deal. Printer Setup connected to the Wi Fi get basically used to all of the technology and the office. In order for them to do their jobs in the most efficient and effective way. Additionally, they receive B LPC history and the mission of OCI which is extremely important to understand why you're doing what you're doing and how the tax payers are the ones that pay all of our salaries, and how, how important it is for them to do the job that they do. They've also reviewed the SOP, our standard operating procedures. There was also an introduction to citizen complaints and how to file a citizen complaint report. Now, they roleplayed preparing a CCR which is very important for them to get somewhat real world experience role playing with each other introduction to the mass system as well as the bo P pamphlet processing online complaints, which is different of course and taking in person and taking complaint statements, all of the ins and outs of that. Here you have just a picture of one of the training sessions that's on your screen, with senior investigator Coulter and some of our trainees right there. We taught them how to obtain audio and video evidence how to do their research. With photographs, medical release forms Police claim forms, police FOIA requests, how to record an interview properly so that it helps hose up. As I said in meetings before sometimes these investigations actually end up in a court and so sometimes we're called actually to defend the research or the investigations that we do. Our trainees also are learning how to send certified mail because a lot of our a lot of our complaint answers certified mail that we send out, calling the complaint the roleplay. They have role played. They prep the complaint that script in other words is a script to make sure everything is unified. So when they talk to particular complaint, whether it's the citizen of the city or someone else, they all they always follow the exact same script. You know, within reason for that situation. They obtained complainant statements obtain witness statements as well. They have been introduced to the OCI database, which includes a plethora of forms and materials that they will tap into to make sure they can do their investigations. Very well. As well as entering case notes. We document everything as we investigate these cases. They talked about the purpose of canvassing In other words, being able to look at video and then sometimes they might even have to go out to the actual scene where it occurred. So they went out and looked at what would you do if you were in an area canvassing looking at the cameras that are in that area? Whether it's green dot cameras, or maybe cameras coming from a business, the importance of the green light on locations, and how to request green light footage because there's a process involved in that as well. They also looked at the importance of external sources for electronic evidence. Additionally, they gathered Reese they thought we talked to talk to them a lot about gathering relevance, relevant evidence because all evidence is not necessarily relevant. So they've been trained on cat event reporting daily detail as far as when when the unknown when the officers are and where they are in any particular point in the city because there are some times that citizens have a hard time identifying officers because you know, maybe they didn't get their badge number or the number that's on the car. However, we are still able to track based on a number of efficiencies that we have at our disposals. I will just move on a little bit further. To the next slide. They had an opportunity to visit a few precincts. We talked about guarantee, how to conduct a proper Garrity interview, how to schedule it. We dealt with the officers lead days so that we understand that when we schedule a guarantee that is done properly, and we'll get the most bang for our buck by scheduling it property properly. As as it relates also to Garrity notices when to appear, how to burn a video. So we have a system called watch guard that looks at body worn camera and how to effectively do that. And we'll be coming back to you later talking about how he did a little bit more effectively. We also show them how to deliver guarantee notices. Why is that important? Because you want the officer to come to the guarantee interview fully prepared that they've watched the video they understand what the complaint is. And so delivering those guarantee notice are extremely important. They did a major deal, major teaching on report writing, how to summarize the complaint so that it is efficient, how to summarize the witness statement and the officer statements researching law and policy and procedure developing a comprehensive report case submit case submission for supervisory approval as well. These again, just some of the things that they are being trained we are anticipating that they will be released to be under senior investigator supervision fairly shortly probably within the next couple of weeks. As a matter of fact to let you know they've already been assigned, I believe two cases. So each of them have been assigned to cases as 10 cases that they're currently working on right now in real time. And these are real cases. And so I'm very proud that they are really ahead of schedule from what we've done in the past as relates to putting your hands on cases and moving the work forward. And so certainly I want to thank our seniors and OCR senior investigators and certainly want to thank a supervising investigator Cromwell and obviously, acting supervising investigators Sloane for just an outstanding job in moving our trainees for
like they have fantastic Miss ministry so we cannot ask
about that. Nope. It is. It is a lot of apartments recommendation that without a quorum. Many questions if you can only accept staff reports.

I want to move just to our case reports as well. Just to update you where we are. And I want to set the the caveat that this is our busy season when the weather change and gets warm. We always receive a bumper crop of complaints. And so from now and to until the fact that until the time when the seasons began to change again and it gets a little cooler. We're going to have more and more complaints giving coming in the door and we're operating just under half a full capacity. Now certainly we have these five that are just starting to get their feet wet. We have three more that's been there less than six months that are not fully in the rotation yet. And so when you look at it, we're going to add and we were looking at hiring three more. So we're looking at adding an additional 11 More investigators to a full rotation eventually and so right now, we're working with 10 and 10. Those 10 Investigators are doing a yeoman's job as we look at the numbers again, this is our busy season and so when we look at the number of complaints that are aged, over 9091 days you're looking at and this is through the 18th of this month, this is through today, we're looking at fat, I'm sorry, we're looking at 308 cases when you look at those that are aged from one to 90 days, that is 56 cases, and then those who are aged zero to 60 days as 242 cases for a total of 606 cases. Next slide. There are 45 closed cases there are currently in review with commissioners 300 closed cases are being distributed to commissioners for commissioners review today. When we look at the performance and again I want to certainly want to thank Secretary Shaw for always providing this information for us. We try to watch how many cases that we have coming in versus how many were actually able to solve and get out out of our door. And right now we're still imbalanced because of our workload. And because of we again, we're in our busy season, but the cases that we have received is 452 versus the cases that are closed on the chart is 333. And you see that right there in front of you. Another metric that we have used and we've shown you all as well is that there are 500 cases that are received in OCI year to date 547 210 of the 2023 cases are closed. Okay. And again, that's working with a limited capacity staff. So I think the yeoman's work that they're doing is they're putting forth their best effort under very strange conditions. They're watching 45 Clay cases closed within 60 days 50 to close between 61 and 90 days and 3013 I'm sorry, 13 closed over 90 days. And then finally, I'm sorry, that's a duplicate of the slide that was before and that is my report as relates to the current cases

I'll be brief here I do when a straight IV team which you know is understaffed, but all of whom really stepped up over the last several weeks and quickly gathered and published educational materials for the board as well as for the public around the license plate readers. And the team did do what it could to accomplish as many wins as possible on the report before the clock ran out. And the board's impacting this technology in it kind of moves down the line. So just thank you to the team for working so hard. On on what we could on that. Your incoming correspondence are outlined on your agenda. And just as a reminder, we do have training this Friday, May 19 from 12 to five that's the bo PC and OCI staff training appreciation luncheon commissioners we ask that you do plan to attend if possible, just to show the staff how much you appreciate the work they do every day to further law enforcement oversight. And then on Saturday, the next day on May 28. From eight to five B LPC training for the commissioners will be occurring updates around the budget we did get confirmation from city council that they did not approve the budget proposal that the board approved and so instead City Council approved the mayor's proposed budget and they will have several impacts to the staff including being budgeted at 413 instead of 15. Investigators starting the next fiscal year which starts July 1. This will have an impact on citizen complaints, obviously as well as backlog so I'm working with chief investigator on what we need to do to work within those constraints. A budget amendment requests will need to be submitted to city council and there are discussions around the time the appropriate timing for that. In regards to committee meetings, for budget disciplinary DPD administrative requests and towing there are no matters at this time for personnel and training. Commissioner Hernandez through the chair. This is for your committee we do have two DPD applicant appeals outstanding for Jerry Lynn Johnson the second and Rashi Dixon. These have been outstanding since December for Johnson in January for Dixon. And then we do still have an outstanding question regarding the executive manager for fiscal. We do have four candidates that have been selected and recommended for interviewing and just need a confirmation on If staff is going to interview those candidates or if we are bringing those candidates before committee so we don't lose those candidates for citizen complaints. A draft of revisions to the SOP was sent over to Commissioner Cedric banks and we are can be viewed on bears in regards to the citizen complaint appeal process. And so looking forward to so that we SLP is updated for that. And then lastly for our Policy Committee Chairman Willie Burton. We do still have Tim policies outstanding to be reviewed
