I'm attorney Linda Bernard, the police commissioner for District Two on the northwest side of Detroit. It's a pleasure to be here this evening and see all of you in attendance. We're going to do a couple of procedural things and to see if we will have a quorum very shortly. And if, if, if we don't get a quorum, then we'll after public comment, then we will adjourn. Um, Today's invocation, I think, is going to be done by you, Reverend Warfield, the head of OCI, let us. Let us pray.

    Father, once again, we come before your presence filled with thanksgiving and joy, thanking you for allowing us to get to this portion of our day safe and free from hurt, harm and danger. As we come tonight, Lord, we ask that your hand of grace and mercy would be over this meeting, that you would guide us by way of Your Holy Ghost power and that you allow the voices and the concerns of the citizens to not only be heard but to be acted upon. We thank you for the commissioners that have gathered, members of the department, the chief staff, all that are here to conduct this business.     Hello, I'm James Ford. I just want to say, God bless everybody here. God bless everybody in this room. I'd like to thank the police chief for meeting my meeting with myself and Theo broaden discussing red light running and drag racing. What a character, what a guy. Even sit down and talk with us, because it's Detroit's most pressing problem. He even said, if we go back to Lansing, he might even want to go. So I take my hat off to him. I just want to say this, you saw me passing out flyers about the Obama weekend. Obama weekend festival is something for everybody, children, we just want to bring back what we've missed. We cried when we lost the State Fair. Now you got a chance to have your own state fair. So get in contact with me. My phone number is 586-918-3061, I do want to say this. We're going to invite all the mayoral candidates to ask answer one question. And the one question is, if they're elected, what would they do about drag racing and red light running in the city? We're sending out the invitations this week. They got to answer that question. If they do not show up, if they do not answer that question, they should not be considered to be elected, and I really believe that.     Hi. My name is Karen Gordon, and I'm here to say that once I was ran from my home on the east side at Fisher because of burns Fisher and Seneca cult block club, I told I asked to speak to the captain, Captain and the commander. They never would talk to me. I had a detective, Clark and Walker no called and stated that every police report I made, which I made a lot, because I was tech, and for every attack I had, I had video, because before they said, Without video, they couldn't do nothing, so I put up cameras around my home to show that I was being attacked, and Clark and Walker said among themselves and other people, was in the room because he was talking to me, but he forgot to hang up the phone because he was too busy wanting to talk about me instead of giving me his email so I could send them the video. In the video, they state how every report I filed, they made sure. They made sure that the prosecutor would throw it out. And then the sad part about it is I asked when a meeting with their boss, the head detective who makes the final decision. And he said, I do. I said, So you mean to tell me a woman could come at me and attack me and have been told to stay away from me. It's okay. And he said, Yes. And then Walker stated that the commander wanted her in the meeting to justify what she did because he didn't want to be a part of it. Let her answer the question and he's and she said, so he thought I was going to change my mind. They talked about not just me. They ran me out of my home. They ran me out of my home. They threatened that people should do that they fell, should do something to my home. Excuse me, me and my baby no longer fell safe and said, We have excuse me, because the police

    are part of the cult. Excuse me.

    Excuse me, Miss video, excuse me, Miss woods. Um, where's Reverend Warfield? Well, there he is. Reverend Warfield is the head of OCI. Have you given your complaint to him?

    The complaint, it ain't, went nowhere. I've been going through this for over three years, and all I ever asked the police was for help. I did it the right way.

    Wait a minute, please, please test miss. Wait, wait a minute. Your time is the only one that was destroyed. Yes, and I have ordered, order, then work order

    from my house to see how many cameras I got and my baby said it's a mess. We can't talk any Oh, this do something.

    thank you, um to the board and thank you, Miss chair. We received the this complaint in May, and it is one that we are actively investigating. We just got the complaint last month. Okay,

    thank you. If I may, through chair to Mrs. Gordon's point, I've actually met with MS Gordon under two administrations of command leadership. At number seven, we sat down with her, we talked through we looked through all of her cases. We even looked through some of the complaints she had about a previous commander there. Everything we're doing, we're 100% answering what she's doing. We're being very responsive, and she wouldn't look at me, but 100% I've met with her on several occasions with the command at number seven to try to answer a complaint. So we'll do so again.     good Lord, I'm Minister Eric from right here at Sacred Heart Catholic Church here in Detroit. This church has a rich history of social justice and black liberation. We have a jet black Jesus on the cross and a Black Lives Matter banner on our pulpit. It is in the spirit that I say these words that I have said before, policing in this country is sick

    and DPD is part of the problem.

    Policing in this country is sick because cops have the constitutional right to lie to citizens, whether it's a traffic stop or at a gas station or wherever they are. They cannot lie in a court of law, but you can lie to us, that in itself should say a lot about what happens. DPD is part partially the problem too. Your facial recognition technology supports the tool of institutional racism. Facial recognition technology allows that system this identified people of color more than white people. So in itself, you are saying white lives matter more than black lives. That's the only conclusion a reasonable person can have for the board of police commissioners. They will even lie to you on their agenda page three, you will read that the Board of police commissioners has the final authority and discipline. That is a lie. 99% of the officers that are disciplined get their discipline overturned in binding arbitration. I guess that's all I have.     Hello, I'm Shea Howell, and I'm a member of District Two, and glad to see my Commissioner chairing this evening. Welcome. Thank you. I'm here to talk about the resolution on the protection of the First Amendment, which came to you last week and was introduced by Commissioner Moore. It's a resolution that gives the board of police commissioners the opportunity to stand up against the outrageous violation of First Amendment and due process rights that are happening on the federal level. We are watching federal government agents do things that no rookie Detroit police officer would consider doing. They are wearing masks. They are refusing to identify themselves. They are squashing dissent, and all of us have seen what's happening in LA. We, we from the Coalition for police transparency and accountability have written opportunity for you through a resolution to make clear that the Detroit board of police commissioners will not tolerate any federal troops on our streets, and we will not tolerate federal action that contradicts the policies and behavior of our own police department. Our police department sets the standard for what we expect from law enforcement, and you should direct the chief of police and all representatives to meet with their counterparts and make sure that Detroit streets are safe for our citizens and that the many, many years of effort that we have spent in establishing good Community Relations continue.     that's me. Good evening to the board and staff as well as the citizenry. My name is Reverend Lucius Conway. I am for attorney Bernard. Seat at the second district for the board of police commissioners. I rise first of all in support of what Sharon Howell just shared with regard to to the resolution and its passage. It seems that this board serves as a paper paper lion, paper tiger. However, the term is has no teeth, and I am remiss at how non responsive this board has been to me personally, on May 23 I submitted to the entire board, individually and collectively, a protocol to help remove the backlog, which has doubled nearly since former Board of Commissioner. Now employee Warfield has taken over that particular office with his seven point plan that backlog has has not reduced, and of course, he's saying it's staffing, but there's some infrastructural issues as well, which are addressed in the documentation that I provided you with, in addition to the fact that we have so many citizens who are not getting for you, so much stuff that's happening with regard to our presumption of misconduct. We talked about that in committee, and I just wanted to say that if this board can't do anything else, you can resolve to send a resolution to the city council to put at least an ordinance on the book, making the presumption of misconduct an ordinance so that when these police officers do not turn on or wear their body cameras, the presumption of misconduct this board passed several years ago that has still yet to be acted on, can somehow at least provide the citizenry with some legal resource recourse so they can sue. My name, again, is Reverend Lucius Conway, and thank you for your time.

    Thank you on the issue of the Freedom of Information Act. Conrad, your office handles those requests for our office. Do you want to explain to the public what we do with that? Or would you rather we do it a different time?

    Excuse me, madam. Chairperson, we get 9000 a

    little bit. Or else you guys need to turn up his mic so they can hear him. I think Don

    we get 9000 Freedom of Information Act requests a year. The statute requires that they be responded to. I think within 45 days. The vast majority of the cases, unfortunately depend are directed at DPD, the department I know has three or four civil civilian persons dedicated to responding to the request for information that come from the law department. I think we have been responsive. And if we and if we're not, then there is the possibility always present that will be taken to circuit court and costs will then be assigned to the law department for a failure to meet the deadlines imposed if there are Concerns separate and apart, letters come in to us. We I read them, and I think that largely we have been responsive. And if not, you know, we should just be. If there are concerns about non responsiveness, we should be made aware of them so that we can rectify the problem. But the bottom line is, is that I think I have nine attorneys, Madam Chairperson, dealing with FOIA requests exclusively, and I know that in DPD There are any number of civilian persons whose sole responsibility it is to respond to these citizen requests, so we're working on it as hard as we can, and if and if we have not delivered, let us know so that I can personally be sure that we're responding in a timely manner.

    Thank you. Conrad mallet, of course, is the Corporation Counsel for the city of Detroit is in charge of the law department and also responsible for providing legal advice, as well as litigation support and attorneys in the event of any and all lawsuits. Who's the next person? John,

    Hi Victoria, good evening. Commissioners, Good evening, Madam Chair,

    okay, can you hear me? Good evening commissioners. My name is Victoria Camille, and first I would like to also stand in agreement with the board adopting the resolution strengthening and unleashing local control of law enforcement to pursue accountability and protect constitutional rights and standing in opposition to Executive Order Number 14288, that's on your agenda. I don't know what some people think that they're going to do in Detroit, but in Detroit, we uphold constitutional rights, and that's what we're going to be doing here. And so we look for this board to uphold that as well.

    Through the Chair. It's it's actually quite convenient that Corporation Counsel Conrad mallet is here today, because my concern that I'm bringing forward is in regards to his office. So just to refresh everyone's memory, and I know it's been a while, because we're coming around on anniversary of the murder of Sherman Lee Butler in July, where he was murdered by a bailiff, and DPD was present and tased him before he was shot by the bailiff, and there was just egregious disregard for policy that resulted in this man's senseless killing. And so in response to that, I submitted a complaint to the Office of the Chief Investigator, which has been closed for at least a month now, and on April 9, I submitted a FOIA request to counsel mallets office, requesting the report to be provided. It's very important that we understand that when Sherman was killed, very quickly, the department and prosecutor worthy came forward in the media to very quickly help everyone understand that he was killed in self defense. It wasn't until six months later, after insisting on the body worn camera footage being released, that we realized that he wasn't killed in self defense and that he was instead murdered, and yet, we have not had anyone come forward and publicly talk about that the video, it was partially released around Christmas with very little media coverage, and so that just reinforces the fact that it's important that body worn camera footage is captured and that is released timely, because the citizens of Detroit do not need to be lied to, and we can see for ourselves what happens on Video, and we need to have that to happen. I would hope that Corporation Counsel mallet will honor the FOIA request. Please send over whatever invoice for whatever amount you need to charge, because this information needs to be brought forward. That request is outstanding since April, and DPD should have nothing to do. They should not have their hands on that request that was investigated by the Office of the Chief Investigator. So between the law department and Officer the chief investigator, we need to get that report, and it should not go through the hands of DPD. Thank you. My name is Victoria Camille, thank you.

    Hello. My name is actually Sharon Solomon. I kind of reiterate what most of the people here have said. Because, you know, in 1974 when the board of police commissioners was first established, they had much more authority and autonomy. Today that has been severely diminished the of um, the board can be usurped by collective bargaining and the unions. So I'm just wondering if the members of the board feel that they really have a purpose when it comes to looking out for the best interests of the people of the city of Detroit, because you hear so many complaints about complaints going unanswered. Where do we go to try to get more authority for the board? What do we do? Because if you have no real authority, what's the real purpose? Thank you. Thank you.

    Hi. Scotty Bowman, founder of Draco, Detroit, residents of antique civilian oversight and current CAC member and BCA member. And fairly soon, police commissioner, um, I'd like to kind of follow up on what's been said about authority. Actually, I would say the board of police commissioners is the final authority on promotions. However, just as I have a right to free speech, however, that doesn't mean that I always would exercise my right to free speech. It does not always mean that I'm allowed to exercise my right to free speech in a similar manner. The charter gives the board an authority. Unfortunately, as one person just mentioned, that authority has been usurped by a legal process. There is a way to challenge these usurpations, and that would be to appeal these decisions when there is a arbitration hearing that where they come to a conclusion that's against the charter. So one thing is appealing. Of course, you need an attorney to appeal. So the board needs to also, which it has the authority to also? Do have its own attorney. Furthermore, we have the matter of, well, what does an arbitrator decide based on? Anyway, the arbitrator decides based upon the contract. And so what you need to do is make sure that city officials don't undermine their own In fact, I would consider it malfeasance for any city official to negotiate a contract that has language in it that bypasses or works around The language of the charter that we need to prevent city officials from negotiating contracts that violate the Charter. And if you do that, then the arbitrary then it wouldn't even go past the arbitrator, because the arbitrator would look at the contract go the contract right here says the board of police commissioners is the final word on promotions.

    yeah. Adam Barrett, I live in District Six. I'm a member of Detroiters for Tax Justice and moratorium now coalition and etc. Just here tonight a little

    bit. So thank you so much.

    Yeah, I'm just here tonight to stand in solidarity with CPTA and their ask around the resolution, you know, rejecting federal interference with local law enforcement. Detroit Police is Detroit Police is under charter mandated control of the citizens of Detroit, so I ask that this board does everything within its power to make that remain the case, regardless of what federal authorities want to do in our city. Just quick side note this executive order that's being referenced from the White House, number 14, 288, maybe it's nothing, but I doubt that it's nothing. But the numbers 14 and 88 are probably the most common white supremacist dog whistles in the book. So that, I mean, you can go to the ADL website and look that up if you want to verify what, what exactly they refer to, but that's, that's where we're at with the federal government right now. That's, that's the kind of thing that they're on. So thank you.

    Hello everybody. I'm Danielle Murdock. I was told about this meeting today by Warfield. Me and my children are here today because I'm emotional. Sorry, but like that second lady who got up here, we are targeted at our home. We live on Goddard street off in McNichols, in a very bad neighborhood. The police come there once I call them, and it's kind of like we're the suspect. Okay, recently, I've been living at my home for 10 years, but recently, the newer people that live on the block that have been living there all their lives, 40 plus years, are targeting me and my children. They are bringing notes with drones into our yard today. They have scratched in their name and somebody who I was seeing name inside of my Durango on the doors every time I go to the precinct, or when the precinct the police come to our house because, not to mention the neighbors who are trying to get us out, they have hacked all of our devices so they can use my phone to call 911, to say that I've killed my kids, so then my house is getting swatted by 15 police cars, guns drawn, check in, door knobs surrounding my house, while me and my kids don't know what's going on, because we didn't do this. This has happened more than 50 times since December. I believe I'm getting no assistance from the police, because when I reached out to Reverend Warfield about something that happened in October 2023 that got them under investigation, they don't like me for that, and I believe that is why every report that has been taken from me going down there or from them coming to Our home because my home has been squatted, so they're swatted. That means a lot of police coming like we're drug dealers or killers, in case anybody don't know what that means.

    They're acting like it's and

    I don't understand why, but the only thing I could think of is because they're mad because officer tylis and Officer Keller from the 11th precinct violated my constitutional rights, and I'm smart enough to know that, and I was smart enough to call the precinct to get my registered legal firearms back, and then they got under investigation, And from that point on, the 11th precinct called CPS on me. I know because CPS worker told me they called Adult Protective Services on me. I know because when they came and did the visit, they told me they checked me, my home, my children, and

    said, Excuse me, you, unfortunately, your time has expired. Okay. Do you? Do you? Are you familiar with this case as well? Um, no, I

    want me to go. Yeah. I believe this is, uh, from 11 precinct. So what I'll have is I'll have some officers

    get this is all the rock staff been collecting from them throwing rocks at my house since who's been out. This is all the police reports. Plenty of the police reports are not in the system. I've called and talked to detectives, and they said, we don't see that one. Oh, that's not in there. Oh, that's not in there. I have them right here. I have them right here with the officer name on top that did them the computer hacking. No one has contacted me. They said I'm schizophrenic

    through the chair, yes, well, I'll have someone to respond as well from the back. Uh, Commander, can we take take that information and I'll make sure we get back with her, myself, personally, as well as the command team from number 11. I have all the

    Elena Herrera, thank you. Good evening. Can you hear me? I'm Elena, her other I live in District Six, and I'm also a sister of a retired Detroit police officer among the first Hispanic officers. And I also wanted to just reiterate that our community is under siege, and for those of us who are watching what's happening with ice in the community, we are asking for the Detroit police not to align with them, because we're being terrorized, literally terrorized, when I've been at Western High School for the last six months working, and the students are literally being hunted outside in the community. Their families are don't feel safe to go to work. It's very difficult. And when we have absences, we don't know what happened. You know from watching all the news that a student has been deported this week after having gone on a field trip. He's now in Columbia. This is a student who should have graduated this year. These are not criminals. These are they were refugees. Some of them were, were here on visas that have now been revoked because of the Trump administration. I'm asking you, as the Police Commission, in remembering remembering the role of the commissioners, remembering that you were to be citizen body oversight of the police, right? You're supposed to oversee the police department. We don't want to have a situation like we have in Taylor where the Taylor police are turning over families to ice. We don't want to have these agreements where people feel completely unable to trust any law enforcement. Law enforcement is scaring the people. I'm asking you to stand up and do everything that you can as your role in commissioners. Thank you. Thank you,

Elena Atlanta, I've known you for a very long time, and I'm so glad that you came to a meeting, because I have been bringing this up at several meetings about what is going on, but it really is more effective when people from the community actually come and speak about this.     Tara, good evening. My name is Tara Brown, and I just want to uplift the comments made by the members of CPTA, particularly those of Vicki Camille, yeah. I'm glad Conrad mallet is here. I have sent emails to your office that have not gotten a response. So respectfully, Mr. Mallet, y'all don't be responding to those emails. The other thing FOIA was brought up now I have not had some of the experiences that some of the people here are mentioning about FOIA. What I will tell you is getting back to Sherman Butler, when I requested his investigation file, after it was closed, I got a bill for $6,000 $6,000 I asked for video camera. All of that included $6,000 you know, people in Detroit don't have $6,000 the other thing I wanted to bring up is the obvious conflict of interest, the elephant in the room. How is it that Conrad mallet is representing the city and now he's here representing the BL PC, because I can assure you, if Sherman Butler's mother goes to sue the city, Conrad Mallett sitting over there will be the person representing the interest of the city of Detroit. So how is it possible for him to represent the interest of the BOP, see, and the city of Detroit simultaneously. Again, I respect Conrad mallet. I think he's a good attorney. I think he's good at his job. I also don't think that he should be sitting here representing the bop. See, obviously he can observe. But, I mean, how is this working out? The other part of that is the terror to the neighborhood that Elena Harada brought up. I mean, it's despicable that black officers are helping to push the agenda of Donald Trump. He don't like us. We should be in solidarity with the people getting put out of this country. Because, guess what, after they finish messing with us and everybody else who ain't got papers, they are coming for black people. White has kept their coming now with just some of these executive orders that have been passed, what the hell are we doing? That has been my time. Thank you.

    hello. Can I be heard? Yes, okay, I like to say that. I like to encourage everyone there and listening. And it's going to be looking at rebroadcast to encourage everyone to vote. This election is vitally important. We have to remember them both in August and in November. Also, I do know that there is a problem with foils. I know I personally filed a FOIA dealing with the vopc two years ago, and comrade Molly and no one from the law department has ever responded to it. I figured I'd let it go a little bit longer, and depending what happens at the August primary, I might be doing something with that that would draw nationwide attention. Also, I think that more attention needs to be done. As relates to there are a lot of people running red lights. There's a lot of people running stop signs in the city. There's a lot of people that run up to the stop to the red light, then they go around the people is already waiting for the light to change and run the red light. So I think the city needs to do more as it relates to people running red lights. The city also needs to do more and some of these neighborhoods where they reconfigure it, you know, went from two or three lanes down to one lane in each direction, that those are creating hazards for people all over the city, that they are creating a whole lot of accidents, and it's very problematic, especially when busses are picking up and dropping off people. You know, I can see why my insurance is not going down because whoever came up with this concept, and this idea is not very well thought out, because there are more accidents, there are more hostile people because of the way the streets have been reconfigured. But hopefully y'all will all have a nice day and not and y'all will be hearing from me soon. Have a goodbye.

I wish I was there in person to be talking directly in front of Corporation Counsel, because that, that FOIA request, that Victoria Camille mentioned, is very important. Accountability is very important when it comes to our police officers. We definitely need to have visibility when it comes to community the community relations with officers, and the fact that they are out in the community amongst people that they didn't grow up with. They don't live in the same neighborhoods as and they don't really represent in the same communities. They don't live in the same communities we do. So we need to really be able to monitor actions when we come in. We have negative interactions with the police, and we have these complaints also, I was at a at a random situation last night. My friend got into a little vehicle accident, and I seen two young black officers. Made me very happy to see young black officers on the force. Also, want to say the fact that Southwest Detroit is being targeted by ICE is terrible, but Detroit Police Department should no way, shape or form, be enforcing federal statutes. Federal Government is not in charge of Detroit Police Department district, City of Detroit is in charge of Detroit Police Department, and we are governed by the charter. And this board does have way more power than they they lead on this. This board has so much power, especially when it comes to promotions, when it comes to suspensions, when it comes suspensions with or without pay, that is very important when it comes to police department and how it is governed. If you can't be promoted because of your disciplinary actions or things in your file your history and the board can stop that. That is power. If you can be suspended without pay or with pay because of the board's vote, that is power. I hate when I hear commissioners say the board does not have power. The Board does have a lot of power. It's about if you exercise the power correctly. Also, we need a lawyer that is independent for the board, not one from the corporation Council.
