Mr. Hurst has a master's degree in public administration from the University of Michigan in addition to a Bachelors of Arts from California State University, his current role, he is the Deputy Executive Director of Business Operations for the Detroit Public School System. Through this, he manages and maintains and oversees the departments of 120 buildings under and 20 plus buildings of that organizations portfolio. It is with great honor and great pleasure that I'd like to introduce Mr Hurst's to this honorable body. First.

Item number two is requesting commission approval of the appointment of Melissa Fernandez to the position of Director of the Department of Juvenile and Youth Services.
Good morning. Good morning to now our chief operating officer with the wayne county executives office. It is a pleasure to actually present Melissa Fernandez, who we all know now who currently serves as the Director of the juvenile Youth Services Division. And Melissa joined the county just about a year and a half ago, but she absolutely has shown that she is a legacy player. And in her current role, she actually oversees $100 million budget of direct and contracted services, including our juvenile detention facility. She also serves as the chief administrator on the county's child caring institution licensed for the facility. But there's a lot that you do not know about Melissa would like to share more. Melissa actually holds two degrees of master's degree in social work and a Bachelor of Arts in Psychology both from the University of Michigan. She is also a Licensed Master social worker and started her career as a therapist with Huron Valley Center and she actually started as a social worker where she actually provide a counseling in group therapy as well as individual therapy for adult convicted felons. She then moved to the juvenile justice arena when she served as a family therapist at Boys Ville of Michigan, where she counseled them, youth and their families. She then moved into more a residential treatment center facility where she continued her work as a therapist, but actually served is every facet of a role in a residential facility treatment as well as actually going up to the executive director. So she served started as a clinical case manager. She served as a systems manager and assistant director, a clinical services manager for quality assurance, re entry grant coordinator, the Prison Rape Elimination Act coordinator and Grant Program Coordinator, the center director for missions marketing coordinator also as the Chief Operating Officer and ultimately as the executive director for Spectrum juvenile justice services. So she has had just tremendous experience in the entire juvenile justice system. And right before she came to the county she was the chief operating officer for the Methodist Children's Home Society, which is a child welfare agency located in Detroit and reffer, providing foster care and adoption, transitional living Child Abuse Prevention and Community Wellness programs. Melissa also received the 2017 Michigan Business Association Shooting Star Award and co authored an article titled reducing juvenile recidivism through specialized reentry services, a Second Chance Act project, part of the Journal of juvenile justice during one of the most critical times as we all know with our juvenile justice system, Melissa also shown to be a tireless leader and exceptional leader and someone that our staff really record really respect support, and really look forward to working for a long time with the county. So with that at present, Melissa.

Item number three is requesting Commissioner approval of a three year Medicare group enrollment and coverage agreement between the Wayne County staff and retirement group and Blue Cross Blue Shield of Michigan.

So
we come before you today for a voluntary Medicare Advantage Prescription Drug Plan for our Wayne County stipend retiree group. This plan we vetted and felt that it was better than what was previously being offered to our Medicare or a Medicare stipend group. And so this plan is very cost effective and is much better than the one that we previously offered to the group. We also met with sub chapter 38. To have them review the options that we had in front of us and they also agreed that this was the best choice for their members. But the members of credits group
How many members are in the group?
There is 900 that are enrolled in the plan. There is approximately I think 2600 that are in eligible for enrollment in that from the stipend program
and what are the differences you've said that there's some differences that made this better than the previous one? What are those?
So the previous plan that was being offered was a supplemental plan and that supplemental plan was Causton. This group that was enrolled approximately a little bit over $200 a month. For the coverage this coverage cost the the stifle group $11.25 A month
are excited to have this good. Okay. With that the biggest difference the cost so with any change in plan
this was a Medicare Advantage Plan whereas to what was previously being offered to the group was a supplemental plan. That supplemental Medicare

when you met with the group, the estimated numbers that were in the meeting met lots of leadership. Oh leadership not with the actual group
like at least five or six people, okay represented the various their chapter is made up of a lot of different you know, union type thing, but they all come together as asked me subchapter 38 So we met there was a few people from like, retirees from poem from GA from asked me they were all had a chance to review the plan and the options we put in front of them to say which one do you consider the best?
And so they took that back to the membership in the general membership was in agreement is that which were say?
They, they had meetings with the general membership, if I recall, where the broker actually went out and gave them an understanding of the of the plan in what it was
offering.
I don't remember the timing exactly in terms of whether it was after they made they said look, this these options of these options. We think our membership would like this the best let's bring this to the membership. They definitely had meetings with the membership ahead of time to let them know kind of vetted out.

Let me ask you this is not the the your normal program plan for the retirees Is it the one who they put the monies in to into a program? I'm not talking to
this we have our mirror the mirror retirees which are the retirees that retained health care after 2015 When When the the big change happened, and then where we split off a group of retirees like the McDonald class and others that went into a stipend program. So on one side you have the mirror retirees who retained employer paid health care. And then you have the stipend retirees and this plan applies as a voluntary plan for that stipend group only. That's the only group that's available. The mirror retirees have their own ma PD Plan that the county offers that mirrors the actives to the best of can under Medicare circumstances. Right. So there's two different plans. One is employer paid an employer that we do everything and we track all this and then there's this one that we had put forth for the convenience and as a courtesy to the retirees that lost health care. So they would have a plan option that they could choose. If you ever had a strategy
to do it the mirrors plan. Yeah. Okay.

Thank you Madam Chair, and I'm wondering through the Chair, if our commission counsel would would just comment on some of the concerns that were noted with this contract. Especially one of them being that this contract is not through the county, right. It's with the Wayne County stipend retiree group, instead of with county, so I was wondering if she could comment on this.
Through the Chair to this animal robot. It is noted in the analysis the parties to this contract are the Wayne County stipend retiree group and Blue Cross. And we did ask the department but unfortunately didn't get a response back as to why typically, the legal entity Wayne County is the party to the agreement. And I don't know if this is an industry issue as to why it's titled the way it is. But again, we didn't get responses back so I don't know if you can tell us now to maybe explain why it's not the county but the stipend group is the party to the agreement.
We do apologize for not getting back but we were working on the responses to those questions to submit to the Commission. The reason why is because we are only sponsoring this program, and the actual plan is for the Medicare stipend retiree group. However, if that's something that the commission would like us to change, we can definitely amend that and we're add that the county is only a group sponsor
to the plane. So through the Chair, I see court counsel stood up I'm gonna actually defer to court counsel because I don't know what it means to be a group sponsor. And if that's sufficient, or if it's sufficient for just the retirees typing group. I'm not understanding the intricacies of it. I'm a defer to court counsel for
that. Thank you. Thank you try our lead attorney for Corporation Counsel and with the what preciouses said and the further information about that this may be done with other groups in the county. We believe that the contract could be done this way but in looking at that it may be extended to other groups that are of retirees. We've researched and come up with a potential solution for this that should satisfy everyone.
It is Stevens Cooperation Council. Upon further review of the matters. We're pretending to this issue. We believe that we could amend the contract so that we have the county as the sponsor of the plan
is that it would be through the county as the plan sponsor.
Do we need to take this back to have that amendment put in the contract or approve this?
I think it could be approved with the provisions that we will mandate that portion to say that it is through the county as the plan sponsor. Yes. So

so just for clarification, will that amended contract then be provided to the Commission afterwards our records are reflect what it is Do you know the language so we'll be very clear about what we're actually approving today. Yes,
yes, it will be it will. It will add the language through the county as the plan sponsor. The plan sponsors a defined term for this plan and then that would cover this contract for this situation as well as any other future groups if that is done as precious indicated, is potentially the plan if this is a beneficial plan to other retirees that want to have Medicare Advantage,
similar to other contracts where we say the county of way as enter into the agreement through the Department of blank this time, it'll just say through the county as planned sponsor. Yes. Okay. Just wanted to be clear for the record that that is the amendment. I'd have no issues with that, Madam Chair.
Thank you, thank you for that and the other. The other concern I had and I think council had it as well, is that this agreement would automatically renew each year after the three year term has expired, and it won't come back to that commission at all. And I'm wondering about response from our counsel as well.
Here's what
I think we're referring to the automatic renewal. Yes. Again, this type of agreement is somewhat different than our usual agreements. And so I'm gonna defer to the Department of Work counsel to explain why it would be necessary in this instance, there are no monies from the county directly coming from this is actually paid I believe by the participants. So it may make sense for them not to have to come back but again, since we didn't get responses, if you can just explain.
Here once again from Corp counsel one of the issues in this particular type of contract as was indicated these people who go into this program are going into what's called Medicare Advantage. And Medicare Advantage is something that once you enter into Medicare Advantage, you know, you cannot go back to a supplemental plan for Medicare without potentially having medical underwriting. So the need to have this carry forward is important for the participants because when they are in this plan, this may be the plan that they want to keep and they don't You don't want the plan to expire. For those who have chosen the plan. People can once a year choose another Medicare Advantage as someone stated a generic one. But there could be very valid reasons why someone wants and needs to stay in this particular plan. And we don't want to mess with that because that's people's health care livelihood.

And this board again is for someone to the state of Michigan social welfare act 1939. So it's been around for a minute every county in the state has representation on the board
or the chair so this is the Health and Human Services social service service board under the Social Welfare Act, and this board is responsible for reviewing and submitting recommendations on contracts involving programs administered by the family independence agency. They develop and administer employment programs and training programs complementary to the state's family independent agency and their programs. They conduct in conjunction with the family independence agency and annual review of social service programs operating within the county, among a few other similar things.
I believe counties around the state have appointments to this board.

Yeah, if I recall the discussion around this. This is MDHHS his way of getting feedback from all of the counties and programs. I was glad to see this on the agenda today. But I was a little surprised that Miss Collins has been on that board for 10 years we've been I've had discussions with her going back a long way about getting appointments to that board. So do we have all three Wayne County members the two appointed by the Commission and the one appointed by the executive to fill out this board now I
think we're still missing one we have ebony is the ministration Edith is ours and think just one more and
I can't be we have record. I didn't see it in the analysis of the previous appointments to this sport. And the reason I'm raising this is I had extensive conversations and I believe they were after 2012 This indicates that 2012 Is Ms. Collins has been on the board since then. But also with here's a blast from the past Sue Ellen Smith Sue Ellen Hamilton. Now I don't have a right to sue Hamilton. Sue Hamilton Smith. Yeah. Sue Hamilton. Smith, about this and being pushed and you know, we got to have somebody on these boards. We got to have somebody representing us up in Lansing. So I was surprised to say the least that Miss Collins has been on this board since 2012. I don't recall that we have made appointments. I'll give that to you Commissioner now tell you that. This was brought to my attention by Ms killings a few months ago and as we did our research, this is why it's on our agenda for the day to make sure that we fulfill this obligation. In all honesty, we have been a little lacks in this and had not received appointments to the board and they had not been active. So now that we are getting them reconstituted, we do anticipate having them come to HSS for updates as to their work on this board. So this is one of those 10s of 10s of boards that we have that hasn't been active. So now that we have it fulfilled we'll start getting active with this board. So she
well I'm glad we're doing it. It made a whole lot of sense to me when Miss Collins and Miss Smith approached me to say hey, we don't have appointments to this board and the importance of it and the importance of it at the state level. So I look forward to getting four appointments are at least going back to 12. But I'm glad we're doing it. I think there's a $600 or something we have to pay to be a member of the board. Trying to get that into the budget was interesting years ago. And me and Miss Taylor go back 20 years so she was an avid supporter of senior services and senior rights at the Plymouth square senior building. And she was my go to so I will deeply miss her. And so glad I had an opportunity to spend some time with her early with earlier this year, and again to celebrate her 100th birthday last year so my sympathies go out to her and her family but 100 years old is an absolute blessing. Thank you Madam Chair. I won't use the term I'm mad as hell. But I am. Fireworks. There are certain laws that we have to abide by. And when you're in government, or you are in law enforcement, or you in like local government, state government first of all, it's it's you cannot let off fireworks if you're have alcohol. You can't let off fireworks in a public street or church or school or parking lot. You can't let off a certain grade of fireworks if they're over certain millimeters. In other words, you can't let off cherry bombs or MA these they're illegal. And law enforcement should know what the state law is. And also there are companies making they're not doing drugs. They're doing illegal fireworks, bringing them to Michigan, bring them to our local communities. No enforcement no checking to see if they're illegal or illegal by law enforcement. And at night. If you have a pet a dog in particular, or if you just flat don't like to hear the fireworks. You can tell the difference between a fireworks and an explosion. If it's rock if it's if you're in a residential area and it's Rockin Your windows, it's probably illegal. So the thing of this we have a responsibility as part of government to talk to our law enforcement to talk to our state elected officials and to talk to maybe even our congressional folks to say you know, okay, everybody loves legitimate legitimate keyword fireworks, but some of the stuff that's going on in Michigan is not legitimate, and there's no enforcement. And so we need to understand that everybody has rights, but the rights are being ignored by people that have little pets, the people that want a private, you know, enjoyment of their personal property and those sorts of things. So I'm just bringing those, I'm venting my personal thoughts out loud. If anybody wants to help me or steer me in some direction, I would love that. Thank you.

There has to be more regulation and you see a lot of accidents. Some of these children's in the middle of the street. These are public streets and private properties like schools and and churches and Amanda put this out there in Dearborn on Ford Road. Some kids were throwing fireworks on cars that are oncoming traffic. It's really getting very bad out there. We do need more regulation and more enforcement. And I hope maybe, you know Sam Jafer can make some comment on this being in the law enforcement. It's it's really getting out of control. I understand your frustration. Whatever there there's something that couldn't be done. I'm in full support. Absolutely.

So, Commissioner beydoun, you guys made the news you were all over the news. With with the kids. You're born out in the middle of the street, setting off fireworks as well as throwing them at the cars. So I can certainly hear you hear your frustration. Second McCormack.
Yes Then I also agree, Commissioner Basham. But my concern is the air quality. We've already been dealing with air quality issues and then with you know, all of the smoke and just from from the fireworks it just made it horrific. So I think just in a environmental way it needs to be addressed as well. So I sign on to that resolution as well. So
I remember once upon a time, fireworks couldn't be purchased here in Michigan people were going to Ohio which you know that they wanted to keep their revenue here in Michigan. So I don't have a problem with our state legislatures revisiting that state sale of fireworks like we had a few years back so we should quite calm and the commissioner Anderson
rebelled. They must be buying these illegal ones somewhere. So the corners that the police are be monitoring, all of the selling all of those popups where they're selling the they're all over because if you if you if you if you monitor them, you won't have you won't have the problem with cherry bombs and all that stuff. So I think that it needs to start there. Well, they had to get a license to open these little pop ups, don't they?

Yep, point I believe. You do need permits. Like for example, in the city of Dearborn, I believe you do need to pull a permit if you have to be on a corner or in a building. You have to get a permit or a license but to your point also, you said June 25. They started doing it early June. Yeah. I mean, it's really out of control. It is absolutely and you know, what would the pets Yeah, I mean, they're petrified, it's scary.

Thank you, Madam Chair. I wanted to comment real quickly, without belaboring it too much further. The when I was in the State Senate, I was the only member of the Senate that voted against the bill when it came through to gut the previous law that had we had more control over what was happening during the holidays. And every holiday is I think that they allow these to continue to be used under the change of the law is just proven. I was right. I mean, I knew it was gonna cause problems, serious problems, not only to to our pets, but also it made us terrorizes them, but as you touched on just a minute ago, just to make sure it was heard even more importantly, our veterans that suffer from PTSD. I voted against the bill when they got gutted the law, but I also introduced a bill to return it to that previous level. Of of control. And, unfortunately, didn't get it through the lobby group that was there for you know, when the bill originally passed, changing the law to cause what we have now unfortunately, it'll be tough to get it done that the lobby group was there telling them how much money the state was going to receive and, and of course, dollar signs in everyone's mind about how much money it was going to bring into the state as far as revenue. It is very sad to see what is happening now and I'm sure they accidents and the injuries to to kids, as well as adults, I'm sure have increased exponentially and we 100% in support of of trying to get the legislature to do something, but I'd like to see us maybe bring it up to Michigan Association of Counties and ask them to spread the word to get other counties to take do the same thing past resolution and I'm sure we would probably see support in other larger counties that have a more dense population before we went there, they are very rural areas of the state but I think we need to do it nonetheless. I have one other thing I wanted to mention that the on on July 4, I had the benefit of seeing someone that I hadn't seen in about five years, I guess with with COVID and everything and with the things that this young man has done. He's from Livonia, and I think Terry would know his name, Nino Monet. He graduated from Franklin High School. I'm sure he was probably a near the top of his class at that time, but just to touch on just a few minutes. What he did, I was really pleased and even though it was on the holiday he he had sent me a message earlier in the week that he was going to be in town. He just got back from Qatar. He is a he's now he's a veteran of working with the he's a Jag actually, which is a defense and prosecution attorney for the US Army. And he served over in Qatar but he's also he was stationed in Fort Bragg. He he brought his new wife that we got to meet for the first time we met and had lunch together. He under an intern with our prosecutor or Wayne County prosecutor Kimora the before he referee graduated from law school. And then he went on to intern for Supreme Court Justice McCormack. of the Michigan Supreme Court. He graduated from law school at Harvard Law School. Very few I would say I would venture to say very few graduates of Eastern Michigan University which is known for its teaching, graduating teachers. I would I would venture to say that probably very few of them, went on to Harvard Law School. And he was president of his class. As I said, he's he's now he's a Jag and he's also going he and his wife are both holding the same position but basically, that he's a captain in the army now and he's going they're both going on to West Point to to work at less West Point now and just wanted to wish him the best and just to mention somebody that's among us, you know, there's there we have so many people that deserve recognition and we we try to recognize some of them. But he's, they've gone back they flew back on on the night of the Fourth of July. But they were flying not back to South Carolina, but to New York and they hope to come back in Michigan. I'd love to see him start a family and that back in Michigan, and but he's just the kind of young man and his new wife. I had just met her just what a team they're going to be as just attorneys. They're both attorneys, and there'll be practicing there in New York In New York State. But anyway, just wanted to mention that he's just mentioned his name, Nino. He's been very active and in the political circles, worked on different campaigns. all over the state volunteering when he was still in at Eastern Michigan and probably even before that, but anyway, I wanted to mention that somebody that under recognized that's all Thank you.
