a resolution honoring Sergeant Willie Smith, whereas Willie Smith was appointed to Detroit Police Department on January the fall of 1994. Upon graduating from the Detroit Metropolitan Police Academy, Officer Smith began his career at the 13th precinct. And whereas Austin Smith spent several years at the 13th precinct Metro Division and robbery Task Force. Officer Smith spade displays tremendous knowledge and leadership skills as an officer and was promoted to the rank of investigator on August 11 2000. Investigators Smith's assignments included a special response team and headquarters surveillance unit. Investigator Smith was promoted to the rank of sergeant on May 4 2001. Sergeant Smith's assignments including narcotics central district investigative Operations Division, fifth precinct detective unit, and prisoner processing unit at narcotics. And whereas Sergeant Smith was a deserving recipient of following awards for the NFL, both for the recognition award Rosa Parks general recognition award the LD All Star baseball Recognition Award, inclusion of the conditions of confinement consent judgment award for fireworks celebration awards, whose chief unit awards and several accolades from within the department and from other agencies and citizens causes professionalism and expertise and whereas Sergeant Smith has tirelessly served the Detroit Police Departments the citizens of Detroit and its neighboring communities for 28 years. He has served the Detroit Police Department and the citizens of the city of Detroit with loyalty, professionalism, integrity and dedication and it is widely respected excuse me, and it is why was respected throughout the law enforcement community as the consummate professional now therefore be resolved at the Detroit board of police commissioners speaking on behalf of the citizens of the great city of Detroit recognizes and honor the long lifelong contributions and commitment of excellence in public service as Sergeant Willie Smith. He displayed of courage his display of courage and unwavering community spirit has improved the quality of life for the citizens of Detroit. I wish you all the best in your future endeavors. This week, ladies and gentlemen. The board was invited to a confidential debriefing by the Office of the Chief athlete debriefing I attended both do briefings. The first debriefing relates to the Greektown incident which many of you saw on television. The second debriefing related to quarter was his first first, the young man who was shot when I'm sorry, shot multiple times who had a knife in his hand a small knife 3.5 inch blade by five police officers. My colleague is going to report on on that and I may, I may provide some backups as well. But in any event, his parents are the critical incident he breathes that I want to share with you. The briefing was held on May 1, two o'clock in the Chiefs Conference Room. President or myself, our Vice Chair Miss Holt and Victoria Shaw our board secretary. This is what our understanding is what was verbally communicated to us by VPS leadership. And as I said the Chief was there and several of his deputy chief of course with legal counsel. This is what happened in Greytown that two groups began to fight for an unknown cause during which time a suspect in wave hands you have to remember there's two suspects here. One grey pants and one in purple pants. So right now we're talking about grey pants. wave hands produces a handgun. A person in the opposing group, they were just coming out of a restaurant first and the opposing group attempts to take the hands on from the suspect to neutralize the situation. But another suspect in purple shorts, who was the main group as the suspect in grey pants steps forward with another hand gun and fires multiple shots. fatally striking the person that was attempting to take the gun away from from grape pants and also shootings to bystanders? I guess multiple was coming out of Buffalo Wild Wings here okay. Except the person that lives of course they only killed by purple pants on you by officers who were all over the scene. I actually as you've if you've been on a Greytown you know that they're police officers everywhere. You hear my officers respond to the gunshots immediately. You can hear them ever no silencers or anything like that. And they was chasing the suspect and purpose she was into a nearby parking garage. Suspect in purple shorts. His cover behind a parked black Mazda, with the driver inside and pointed the gun at the approaching officer. To me it was the most dramatic scene of all the video that we saw. Officer was standing I'm gonna just show you with his with his legs open like this with his gun like this. At the at the assessment you're getting into them either on the other side of the car. The car is here. Officer here. Suspect getting into the car on the other side. His legs are wide open his gun is clearly aimed at that point. He did not he did not shoot the suspect. Yet. The suspect had a gun as well. Another officer shot the suspect in the arm coming from the other direction and the bullet went from his arm into his thigh. So he was I guess some sort of like a flesh wound. Anyway, the the officer who decided not to kill him at that point, of course then he's he's going to other officers. The black miles chased off down the road. He he then the driver in the black Mazda who appears obviously to have been with the guy in the purple shorts. Drives immediately to the St. John's Hospital. Where he gets here he gets that he drops this guy off. The Bat has been shot purple shorts and you speeds away. We found the Mazda later but it was like a stolen car or something and that was what happened. But I want to at this point, just pause for a moment to congratulate the officer who really could have shot him multiple times and he didn't do it. And obviously we waited another helicopter over here so we knew exactly where the black Miles was going. We saw it go to the St John's Hospital. So the stuffs back in great pains is followed by officers into the garage. Under this is the other one other guy and it's apprehended in a Kia Soul. A 40 caliber handgun just recovered from the back of the Kia released it. It's fine 140 caliber casing at the scene so legally he believes this gun was fired at least once a 40 caliber gun can stop and elephant as their big heavy gun that used to see you know and in movies and stuff. It's a huge gun. It's not a nine millimeter or anything like that, obviously was later found a Mazda abandoned on a Detroit street with no weapon inside. There's two bystanders have been treated for their injuries released from the hospital and are recovering. No officers were injured in the accident. The suspect in grave hands was on a federal supervised release and is now facing a felon in possession of a firearm warrant by the FBI by the US Attorney's Office. The Wayne County prosecutor declined to issue a warrant on the suspect and purple shorts. he relayed DPD says Wayne County prosecutor is synonymous with the identification. If he is contrasting as they say this was the suspect with fire the fatal shot. They could make out who it was the arrest is done by the inmate. We couldn't distinguish really whether that was the correct person, but the chief is leading this fight it was with him where these officers just tried to show them the same information that we have obviously and to get a warrant issued for that person. The as I said the bystanders were conveyed to the hospital prosecutor we're really just trying to issue a warrant for the officers DPE citing no policy violation EPD preliminary Administrative Review anticipates no policy violations by the officers. In other words, we create the policies for the police department. And so an officer officer is subject to discipline by us by the sheer fact they violate policy. That whole video demonstrated zero policy deviations by our by our police officers. Our next steps are to monitor when he citizen complaints filed in relationship to the incident and I'm sure there will be some to request an official report from the Wayne County prosecutor regarding the warrants decisions on the officers and the suspects. Because we really want to know why. I there's some you know some confusion about really what happened when I was really on video and there were there was no warrant issued because a second suspect. We want to share more information, including visual aids with the public and the LPC receives them. And then finally, we welcome any questions from the public that we can that we can follow up on as we contribute to as we continue hardly need to follow the sense today. Thank you, Mr. Chairman.

Thank you as has been stated this is the critical incident debriefing on the quarter bursts. officer involved shooting. Now we have had three of these deep briefings and it may seem that there is a continuation of officer involved shootings. But let's be reminded that this one is actually from October of last year, but as a result of community concerns and concerns lifted by the commissioners, the Border Police Commissioner we were invited to a debriefing with the sheet to review the video again and what we were able to observe visual aids that were the videos from various angles in edits to show the raw footage including the shooting, and our distance and time are calculated. We understand that some of this information may seem daunting or repeated what it has already been provided to us publicly through the sheets press conference, but again as a result of what has been requested to public comment and from commissioners at our board meeting, we were shown the remaining footage and the blog wants to share with the community up to this point all that we know and what you should expect next. So 20 minutes prior to arriving on the scene. A DP had approximately a 10 minute conversation initiated by the family where it was explained that Mr. Porter bursts was having a mental health crisis and had been violent, slashing his brother's tires and was armed with a knife and that the brother had the intentions to have just a burst petition that night. When officers arrived on the scene. Just the work was slowly pacing in the middle of the street. With a knife in hand. For Crisis Intervention An officer led the discussion with Mr. Burke with discharge and also speaking to Mr. Berg occasionally CIT officer and just starting at Mr. Burke's repeatedly dropped the knife. It was shared as a column high DPD that they asked a number of 14 times for Mr. Burgess to drop the knife, but he declined. Like they also asked him not to walk closer to sit down. They offered him help and told him that he was not in trouble and Mr. Burke's did not comply and repeatedly responded that he would like to hold the knife and that he wanted to go to DRH and wanted to rest. There was a lot of talking that can be heard in the area and on the radios including orders to the units not to approach cetera as a sergeant is heard saying that he is going to get his car and that was assume because he wanted to put the car has a barrier between Mr. Berg and the officers as a tactical exercise. The sergeant walks away from the scene of behind the officers towards the car and is that that moment as he is walking towards the car, which is about five minutes and Mr. Bursts first starts to walk further away from the officers and then turns and starts running towards a CIT officer with a knife. By this time there were a total of seven officers on the scene. Plus the sergeant one officer deployed his Taser which did not take effect while five officers fired their weapons. Charging a total of 38 rounds in 11 rounds from this it officer is just the birds was struck by 19 rounds based on DPS calculations. Just the Burke was 40 to 30 feet away from the officer running from starting to run to the last shot fired is took three seconds you're gonna want to make sure clear from the point that he started to run. So when the last shot was fired was a total of three seconds. Mr. Burke once you fail, he reached approximately five feet in front of the officers so he started off what are the 30 Excuse me 40 to 43 feet away. At the moment that his body hit the ground he was only five feet away from the officers. Officers immediately rendered medical aid. However Mr. Berg succumbed to his injuries and no officers were injured in this Lane County prosecutor declined to issue a Werthers EPD citing no vital policy violation for the use of force and BPD preliminary administrative review as completed, anticipating the force was used and things with the policies, but they are now awaiting approval and review from Chief white status of the footage release and always been asked a number of times that the entire video we release but body worn camera footage of events leading up to when the first shots began was actually released to the public on October the fourth two days after the incident. At that time the edited videos for the purposes of calculating distance and time were not yet developed. All footage will be released per for your request. After administrative findings are fooled by she excuse me apply she faced DPE estimates one to two weeks or DPD for courage has not been released so far because it is part of the evidence in the open investigation, including the edited videos used to measure time and distance. The border police commissioners next step is obviously to continue to request the immediate release of the full footage to monitor for any city complaints filed in relation to this incident to request and an official report from the Wayne County prosecutor's office regarding the warrant decision and to share more information including visual aids with the public as the board of police commissioners received them. We also welcome any additional questions or comments from the public eye that might aid us as we continue to follow in this incident. That's the conclusion of the report.
My dad this incident happened in October six months ago. I personally asked questions at the meeting. And my colleague knows that I am totally distressed if you will by the fact that this video footage should have been released to the public. They have a right to know every major city in the country where there has been an incident of a person being shot by the police that any incident contain video that video has been released to the community. We are the citizens we have a right to that information. It is not for a conference room and and upstairs in the police office that is wholly in my opinion inappropriate and a violation, quite frankly, of most of the department and and the Board's policy regarding transparency. Furthermore, for me and I listened to the whole thing I think that the guy that was from CCI, or whatever it's called Venture had like a real strong command and control voice. You will have to drop the gun. I mean, it was not the kind of tone another guy had a better tone and you know that's true in terms of addressing someone in a crisis, it was like pushing and it was apparently authoritative, way, way, way too strong in my opinion, to coach somebody to give up give up the guy and then finally five to one. And so this boy shot 19 times is unacceptable to me. It's unacceptable. To me that that level of lethal force had to be used to disarm a person with five people even if it was five girls and one person does I don't accept it, my colleagues.
Thanks chair just by my observation. Again, you know the loss of life. It's always unfortunate, and we tried to do our best as a oversight board to ensure that our officers and police departments are operating within policy and procedure. I just want it to be noted I know that he's been said that the video has not been released. But as his report suggested video was released two days after the incident. The video that we saw in the press conference from the sheets sapped at the moment that sort of Earth's receivable and dropped to the ground. This is a video that I didn't interrupt the video that was shown to us in extinction, if I did some calculations did for police department actors to ensure stunts that was was the only additional footage from the body worn camera the very same body worn camera footage that she shows two days after the incident because the very same body worn camera footage that we were shown in this critical debriefing with the exception of allowing us to witness the Mr. Burke's fall to the ground.
Absolutely. I saw the same exact thing. And the public saw it and I saw the detail part about it yesterday. So Commissioner Presley is correct. The public has seen this video. Yeah. And that's what I've been doing. Are we gonna move on? Chief Deputy Chief?
That afternoon? Yes. I'm going to start with some notes for the for appointment that will come shortly after. I don't believe that it's on the agenda. But it is in my my handouts. So I'd like to move forward with it after. So I'll first start with an update on our engine members. We currently three members of the department who are disabled and recovering at home due to an injury. One is the police officer from the precinct. One is a police officer from the seventh precinct, and one is a police officer from the 11th precinct crime data. As of May 3 homicides you have 80 years to date as compared to 79 at the same time in 2022. That's a 1% change. Non fatal shootings. Currently we're at 226. Last year we were at 217. That's a change of 4%. Robberies this year rent for 33. Last year we were at 410 for a change of 6%. And then final total Part One violent crime year to date for 2023 We have 3864 to last year's of 3646 was 6% increase overall. Moving on to the drag racing, drifting enforcement that we had April 28 through the 30th. We investigated 33 people. We did 33 traffic stops. We issued nine traffic citations. We investigated three vehicles. We impounded two we had two felony arrests and our total stats year to date for the drag racing and drifting enforcement since March of March 24 2023 At this time you have 221 people investigated 142 traffic stops 82 Such traffic citations issued 159 vehicles investigated, eight vehicles were impounded. One stolen vehicle was recovered. We had 10 felony arrest, two misdemeanor arrests and we and we recovered four weapons. At this point we on to the mental health related calls for service for the last seven days. We've had 361 mental health related calls for service. The total calls for service year to date is 5331 as opposed to 2022 1661 According to one that you've reached out early homicide update on the doctor. On Sunday, April 23, officers were dispatched to the 150 block of West Boston to investigate a call to service or a wellbeing check. Upon arrival at the location, officers observed evidence to cause concern with the occupants well being. Officers made entry into the property and discovered the victim's body hidden in a crawlspace wrapped in sheets. The victim suffered a gunshot wound to the head. Texas from Homicide Unit arrived at the scene and began the investigation to stop date. The detectives collected evidence and followed up on investigative leads related to the case, enabling them to make an arrest on April 27 2023. The suspect was investigated and released pending further investigation. The Detroit police department is asking the community for assistance with information regarding this incident. Anyone with additional information is asked to contact Crimestoppers at one 800 SpeakUp Incident Number Three homicide I fatal stabbing on Wednesday, April 26 2023. Officers were dispatched to the 16,000 block of Dexter for investigate a call for service or a person stabbed. officers arrived at the scene and observe the victim lying on the porch semi conscious with a stab wounds to the chest. Officer the admin administered medical assistants until medics arrived. The victim was transported to a local hospital where he was immediately rushed into surgery. However, the victim succumbed to the injury. Officers interviewed witnesses at the scene and it was determined that a large fight occurred at the location and accumulate coins a suspect a female family member of the victim stabbed the victim in the chest as a suspect was arrested at the scene. Taxes from the homicide unit submitted a warrant to the Wayne County prosecutor's office for review on April 27. However, the warrant was returned for additional work to be completed. The homicide unit is working diligently to complete the requested task to reissue the warrant. Anyone with information regarding this incident is asked to contact Crimestoppers at one 800

it's the number four so homicide one fatal and one non fatal. On Sunday, April 13. Officers were dispatched to the 8000 block a smart to investigate a call for service for shooting. On arrival at the location. Officers observed a female lying in the street suffering from a gunshot wound to the chin. The healer was pronounced dead at the scene by medics. Officers received information that a second female was shot but left the scene before they arrived. The second victim was eventually discovered at Beaumont Hospital and pronounced in his temporary serious condition with a gunshot wound to the right shoulder. He had visits from the homicide unit arrived at the scene and began the investigation and received information from witnesses that a large fight occurred involving the victims and a female suspect. After the fight the female suspect to see destroy vehicles retrieved a handgun and shot the victim's suspect left the location and a black SUV after the shooting shortly thereafter, the detectives received a call from linkin park police dispatch, dated seem to call for service from a female space she was assaulted on smart street during a fight and fired her weapon in self defense. Check those determines a suspects location with Linkin Park Police and arrested a suspect. On Tuesday, May 2. He's from the homicide unit. We're preparing a warrants to be submitted to the Wayne County prosecutor's office for review. On Sunday, April 30. Officers were dispatched to investigate a call to service in the 14,000 block of Greenlawn for a person shot. officers arrived at the scene and observe the female standing on the porch of the location. The female stated to the officers that she shot the suspect after he attached her during a domestic dispute. The officers entered the location and observed the victim lying on the ground with a gunshot wound to the chest. The victim was declared dead at the scene by Metis. suspect was arrested at the scene on Tuesday, May 2. He texted us from the homicide unit. We're preparing a war to be submitted to the Wayne County prosecutor's office for review. The Detroit police department is asking anyone with additional information regarding this incident. Today, May 4 at 11am to destroy police Chaplain corps held the day of community prayer as the Detroit Public Safety headquarters prayers you know 1/3 Chief white members of DPW Chaplain corps and local clergy spoke at the event and said a prayer for the city of Detroit. On Thursday, May 4, three reinstated officers were sworn in by Chief white. We now have a total of 32 officers who have returned to the department from various agencies Yes, interfaith memorial service. On Friday, May 5 DPD. Chaplain corps will hold the validity of interfaith memorial service at Old St. Mary's Church located at 646 Monroe Street event, which will honor the lives of first responders who made the ultimate sacrifice while serving their communities will begin with a presentation of hollers at eight o'clock AM and the memorial service will begin at 9am. speakers at the event will include sheep white VPS, Chaplain corps members and local clergy. Practice following the service will be held at the Del Mar Detroit Sports Bar located at 501 Monroe Street. And that is my briefing. I mean, certainly that would be pretty simple for them because all the paperwork you guys write up but it would say nope, I'm not good enough. I'm like, What do you got on Washington? That'd be some kind of repercussions towards that, you know? Because it's like a slap on the wrist. When you're doing that. And then you get caught doing that making something like that dangerous street shouldn't be allowed to have that cop that when you didn't have one, but not that one. Um, that's all I have.

You see a warrant needed to be returned back to the prosecutor's office because the lack of information in the prosecutor, someone's just saying the prosecutor is given his the worn out information that was enough all to Detroit Police Department, and what needs to be completed without warrant without warrant was not a complete, completed what needed to be completed with a warrant? Are you allowed to say that Deputy Chief through the chair
so I'll unpack this a little bit more. Because our our investigators do a phenomenal job. And they put wonderful warrants together. But that doesn't mean that every time a warrant is submitted that that we check all the boxes. in response to what has been said Mr. Chairman, you and Reverend Holly, I'd like to point out and even put on a photo of our boys center that 80% of homicides, those 80 people you're talking about? The people who know each other well, husband, wife, girlfriend, boyfriend, mom and my man is that kind of atmosphere but you know what? You make mad so then I've decided that I'm going to shoot you so isn't anything that can be done. In my opinion as a lawyer in force face. I don't have any stake that label to stop homicides. They are done as sometimes your officiously sometimes when they're swinging you can poison a person or sometimes with a gun or with a knife. So homicide is part of human nature to kill your enemy or who you perceive is your enemy who you because you've lost control now we've we've dissected it as a community, I'm very happy about that, because of the emotions that are involved in terms of mental illness that may be involved all of these things, but only people who really know each other very well. As you said, Mr. Chairman, prosecutor and and I guess I take some umbrage to that, in the sense that the prosecutor is an elected official, they have a job to do. They prosecute cases where the facts weren't clear that there has been a violation of the law. That is not a determination made by the police, that the police's job is in their lane. They enforce the law according to our policies and attorney to the statutes that are on the books. When when the police right up it then it goes to the prosecutors, just like government really have three branches of government. You have the legislative branch, you're getting executive branch, you have the judicial branch. Anyway and when the particular makes the decision to prosecute or the past few years officers, five of which a person and sat COVID-19 made him Swiss cheese, they made that decision. Now, we all know that but when they made the decision to not prosecute a person in the community, they should also be respected for that decision. So I mean, we this is an emotional topic. This is emotional for me. It's emotional for everyone in this room like we're all citizens, but I also think we have to we have to be cognizant of what our role is. If the prosecutor said there's no case, there's no case, that's not our job to evaluate the bullet holes, the best of that, decide if there's a case. They said no, no case. So you know, sort of data on them and all the final points on this issue of guns and I'm gonna call this your attention. Deputy she a 21 year old harming last Monday, as he was another guy on the phone another kid that I know, and he said he had been arrested with a gun. Okay, well, that's the word of God. He's never had any trouble. Oh, my mother never had been in trouble. They never did anything wrong. She told me actually call me about this. This two separate cases. I'll tell you the first case the first person to call me was a young boy who's a fighter. He's well known. He's He's well known in the community. He said he was going to his sister's birthday party didn't have as hard as always, who's walking into it? well dressed and everything we had on cardio glasses with a little diamond on the nose. And so he took him down with him because he didn't want to get jacked on the street for his glasses. And I clearly this kid was eligible and could have gotten a permit to care. Nobody said no, no, no police encounters no foul. And there's another case number two, the one that call me Monday. 21 year old boy works 12 hours a day. has a gun. He said in his neighborhood. There have been three shootings in the last three weeks, two weeks, whatever. You think that he carries the gun to protect himself. Lovely high school graduate eyes kid works 12 hours a day. I don't know why he does that. Anyway, he said that when he called to go and get his license to carry like any of us in this room hoods. The office was only open from nine to three. They have no weekend hours or anything like that. He said, I've tried to go good, but I couldn't. And I couldn't do it because of my work and because of my work schedule. But so that particular day, he's the one he's going to want to work and he gets stopped by the police. I forgotten what the process was, was a stop. I might even show the head probable to stop him or investigate him. But my point is this is that one we need to address the needs of the community to be able to register their guns get permits to carry other than lying the three letter writing because that works for business people maybe but it doesn't work for laborers. who also want to have beef, who also wants to, quote carry legally and people who have had no previous encounter with him. I was just afraid. Evidently the guy that I was talking about that was the boss three the little guy was that a welterweight or something and other guy is a little. I'm just saying there's real life. These people, even some people who carry just a real life situation. So hopefully we can do something about those hours. And it's hopefully we can get the word out to people that if you want to carry and learn, like many people in this room do carrying us is get the permit, and we're gonna make it easier for us to get the permit. As Oscar he worked at the third precinct, central district gaming unit and NorthWestern district precinct as the sixth precinct when Paston offski was promoted to Lieutenant he was assigned to NorthWestern district. He was also assigned to speak to a precinct in October 2013. past and past he was appointed to the rank of captain and assigned to the crime intelligence unit and was later assigned to the third precinct. In April of 2016, Captain pastor was appointed to the rank of commander is assigned to the sixth precinct as the commanding officer. On September 14 2017, then commander task he was appointed to captain is his current rank and assigned to the investigative operations unit. It was later assigned to this pen precinct is his current command. Captain Classic is bachelors of General Studies, a Master of Science and criminal justice, and a Graduate Certificate in Business Administration, along with Captain after education and accomplishments as a Detroit Police Executive. He has also completed several programs such as FBI National Academy in the ocean and leadership program on negotiation at Harvard Law. New Hall is holding seminars educating the citizen on various areas of government. We have been educated we will vote and make better choices. I attended his third session which was on the charter. Dragons district meetings. It has been a long time since the year 2010 Asking for help. And I refuse to give up. I said no to ShotSpotter ShotSpotter has not saved one life. $7 million plus, we could be putting that into increasing pay for the good officers. We could be using that for programs also what is what crime says facial recognition? I said no to that to people who come to this board every week said no to that. You all approve that policy. All it has done is violated our civil liberties over and over and over again. But we've not gotten nothing for our money. The outcome have not saved one life. This should be a contentious board because they're getting information about bad officers. And you all are following up with bad policies. This board is not here to rubber stamp the actions of the police chief of the mayor of anyone else your job is oversight, as you all know that and I'd like to thank specifically commissioners burden and Bernard for pushing back against the like pushing through specifically of promotions and about some other motions and for actually acting on behalf of the people of Detroit and raising these concerns that these things need to be looked at. I got to remind the entire board that everything that comes before you needs to be given due consideration. Ultimately, you don't work for the police department or if the police chief, you work for the people of Detroit. We've already seen based on past news reporting very recently, that the police chiefs recommendation just can't be trusted when it comes to these promotions. We know that he isn't doing his due diligence and as a result, if you as a board need to take an extra week to review these promotions. The police chief should just have to deal with that. That shouldn't come before your obligation to the people of Detroit. For review everything that comes before you and make sure that nothing is slipping by. I'd also like to specifically point out that there are several important policies before the policy commission, and that it's important that every member of that commission attend the upcoming meetings. I can say that we will simply be paying attention to who was able to attend the next few meetings. But I'd like to specifically ask chair Ferguson to fulfill his duty as an ex officio member of that committee to attend and make sure that quorum is met so that business can be passed and thanks can be brought before the entire
committee.

I did read everything. And unlike some of y'all, I actually voted against a number of promotions, because I actually read and understood what I was reading. Off. I think it's an injustice to the taxpayers of the city of Detroit, the Jagang two people suspended with pay that should should have been fired. You know, all during the time I was on the board. I kept suggesting that we need to hire a board secretary we need to hire a chief investigator but we have some people sitting right there that you know wants to make sure that friends and what happened with taxpayer money. You know, it was questioned like said what could you do better do your job, you know, do what you're supposed to do? Understand and understand that you should not advocate and support people with bad records, you know, does not matter what happened? I do do this and they still end up being promoted. Y'all should take a stand. If somebody has a bad record, bow them. No vote now for people with bad records. Have a good day.

And as I'm reviewing them, and not to put the burden on those who are filling out the complaints. I've got our investigators often call to verify the report. And when they are unable to get in person who filed the report. It really makes it difficult for us to be able to adjudicate what has been written and so I'm just asking that those who submit complaints, if at all possible, to make yourself readily available so that when our investigators do call that we can get the most information to be able to adjudicate your complaint.

Thank you, Mr. Chair, and because it's on our board, let me first of all say thank you for appointing me to this position, because it's my hope and my prayer and my desire that we will continue to work with this important office, and we will make significant improvements as we move forward on behalf of the citizens of the city of Detroit, certainly to all of you who are here in this room and those of you who are watching online, our lines of communication are always open and at the end of my report, you will certainly see a phone numbers and my contact information so you can contact me just about any time in your folders under tab number five. You will see a copy of the report. And I will first of all want to thank senior investigator Hiller but actually compiled the report for me and my request. And we have a great group of talented passionate investigators in the office of the chief investigator and they do an outstanding job day in and day out. Whether under resource or not. They come to the job every day looking to make a difference in the city. What I want us to do today is just give up almost like a 10,000 foot overview of how we process the complaints that are filed in our office. Next slide

The mission of the Office of Chief Investigator is literally to fairly effectively and to objectively receive, investigate and make recommendations regarding complaints concerning the police department. I want to make one thing very clear though. Our job is not to meter out discipline. Our job is not to recommend discipline Our job is not to recommend acid. Our job is simply to look for the evidence that either supports or gives definition to the complaints that are filed in our office. And once we file our our reports as relates to the facts that we're able to find those relates to that specific complaint. We turn that information over and we go on to the next complaint, but we are working on behalf of the citizens of this great city. As relates to our staff. We were structured to have a chief investigator at this time. Re supervising investigators, seven singer investigators 15 investigators and two clerical personnel. The Office of citizens complaint serve as the investigative staff with its honorable board of police commissioners I said some of you before I believe it is actually the heart of this board. That without his board, I think without the officers Chief Investigator investigation that this board really lose a lot of his luster to be honest, because it is through the Office of Chief investigation that we're able to follow up on the citizens complaint and literally be that line of demarcation between citizens whose rights are being upheld versus those citizens who may feel that their rights have been infringed upon. All citizen complaints are forwarded to OCI no matter where they are taken in and we will give notification to the citizens of their complaint. They will get a number of their complaint that's assigned to their complaint and the name of their investigator and it OCR determines that an allege actions are criminal in nature, that case will be forwarded over to the professional standards to division one investigation. OCI does not investigate criminal investigations. periodically. We will respond the citizens will receive information on the status of their complaint until it's completed so they will get updates as you move forward in the investigation process. And the findings are then reviewed and approved by a member of the Board of police commissioners. After the approval by the board the Office of the Chief Investigator would notify our citizens in writing of the investigative findings whether or not disciplinary or corrective action has been taken. Next slide please. So how do you file citizens complaint? Well, who can file it? Actually a victim of alleged misconduct can file with a parent or guardian of a minor? A witness an organization an agent that represents the one who was giving the that is victim of a complaint or an anonymous complaint even to anonymous complaints as well. Here's one thing that's very important. No one and or should be turned away from filing a citizen complaint. Our job is to investigate every complaint that comes into that office. So how did you file us as citizens complaint? Well, one of the things you can do, you can file it in person at our office or at polling precinct in the city of Detroit. You can file it by letter, by telephone or by fax. You can file it online, or you can actually scan the QR code right there this on your screen. You take your phone and take a picture that QR code, it'll take you right to the complaint form and you can do that right now. There you have the information for the Office Chief Investigator. Our address is right there. On your screen. The telephone number to the office is there 313-596-2499 Our office is open daily, from eight o'clock AM to four o'clock pm is right in the middle of beautiful Karmakar and again, we do not turn anyone away anyone away who wants to file a complaint as relates to misconduct.
Next slide, please.
When we look at the various allegations that we investigate, there are several allegations that we investigate one is arrest. If the complaint feels that the arrest of a person's Liberty was improper or injustice, we'll investigate that demeanor. And let me just first of all parse out some of the more common complaints that we've received in the office. Certainly the meaner procedure is ours and service are some of the more popular investigations that we do demeanor complaint in regards a members earrings, gesture and language or other actions which is offensive or doubtful. Since I'm sorry, social propriety, there's force complaint that complaint with regards to the use of force against a person. There's also the complaint against an entry that a person that the police may have entered a building or a property that was improper. Then there's harassment complaints that we receive that complaint is that the method of police action was predicted upon factors irrelevant under the circumstances to get law enforcement decision making, and in other words, it was race, it's tied to sex age and things like that. We also have investigated procedures, complaints regarding procedures, complaints regarding violation of policies, procedures, training, or the law enforcement code of ethics, and then search people who complain that the search of their person or their property was improper, and that it's in violation of established B LPC and police department policies and procedures. We also investigate complaints as it relates to property. Sometimes complaints come in regarding property or loss of damage, especially if it's a car a vehicle that has been towed while in police custody or confiscated through some type of police action. And then of course, we investigate service complaints as well. And that's regarding the lack of tardiness or the inadequacy of police service. We investigate all of those.
Next slide please.
This is one of the most difficult slides that we produced because unfortunately what we cannot do is put in a slide format. The complexity, I wouldn't investigation goes through the various steps of an investigation. Here's what I will say that our investigators, their full investigation is extremely thorough. And we literally leave no stone unturned. When I was visiting Lake Cole, and when I was dealing with other cities around the country, our investigators were one of the investigative units that did one of the most thorough investigations of citizens complaint about the whole country. I don't know where that stands now. But I know back in the day, that was certainly the case. And I'm gonna leave room investigation for a minute because I'm coming to talk about that in more detail. But here's some of the other investigation that we do. We do summary investigations. What is that? Well, in certain circumstances and only with the approval of the supervising investigator. The requirements for certain interviews may be weighed when the existing evidence leads itself to a definitive conclusion. Let me give you an example. If someone complains that they were mistreated and an officer cursed at them, if we look at the video hammer and see that the officer cursed at them, then we can literally sustain that based on the information that comes in. Again, we look for facts we're not trying to put our emotions in we're not trying to put reasoning in we look for the facts that support the complaint, administrative closures. That's one of the things we're going to change the word to that because the ministry of closure does not mean that that just paperwork and that's it. No these are actual investigations and the administrative closure is an investigation that deals with a duplicate complaint. So there's a situation and you have two or three citizens that are complaining about the exact same scenario. And so what we do is that we provide an overall and that's template letter an overall investigation. That deals with all of the issues concerning that. And so this helps us not have to do separate investigations for the exact same incident, and it's transferred to the appropriate outside agencies and the complaints against former members and our three or four members if they're retired from the job. We can, we cannot guarantee them we cannot question them. And so it fall under this category. When you look at the next category of of complaint closure categories is informal complaint resolution. And this is the resolution of a citizen complaints that allege only inadequate service or the complaints and incidents of a charge. And so we deal with those two. Next slide please. Yes, I want to deal with I want to deal with the flow and investigation. That's why I want to get clear, hopefully. Full Investigation is the broad umbrella that covers the other three that I just mentioned. And with the full investigation, once that complaint is made, whether it's through a DPD precinct whether it's through online, we always contact the citizens. So no matter what that CCR says we will contact citizens and hear directly from them. Why? Well, first of all, because we know that translation that sometimes communication is lost in translation. And so we want to get as many facts as we can, in an effort to make sure that we are investigating the right thing we'll contact the witnesses many times are investigated for blockage canvass the area I remember in two training classes ago, one of our one of our two of our investigators, new investigators, they were it was trained by supervising investigator Sloane I believe at that time and they were given the instruction is to go out and look and canvass the area because there were some materials out there and when they wouldn't canvass they've sought out a wallet that was related to the case. So best type of hard work, we'd go and look at cameras. So we'd go into those areas when we can see them houses going to businesses, if there are cameras that might add to our investigation, because again, we're looking for the evidence that will allow us to make a good decision at the end of our investigation. We look at all the electronic evidence. We guarantee officers when necessary and when needed. We've talked to a number of witnesses. We even look at additional information that right now that's not part of the initial complaint, but we call it additional findings. So if we see something that occurred that breaks policy, in that incident, we will make a report of that as well. And we will make a recommendation what our findings are, and we'll pass those findings on to the board. And this is just a sample, just a sample out of a whole report. But just a couple of pages of the report that you'll see here. There are pages there are some reports and investigation that we do that are 4070 pages long. And that's how thorough our investigators work.
Next slide please.
Now we're gonna have our findings and these are the four standard findings or conclusions that we come to at the end of the investigation. exonerated and that is where a preponderance of the evidence shows that the alleged conduct did occur, but did not violate the Detroit Police department policies, procedures or training. And we do know that that happens sometimes, because you know, we see the reports. So just because the app happened, that does not necessarily mean it violated police policy, unfounded. That is where the investigation revealed that no facts to support that the incident complained of actually occurred. What that could potentially mean there was no evidence that we came across either the body cameras weren't working, or the witnesses wasn't coming forth. We want to get in the club cooperation. But we as an investigative unit, could not determine that the action did or did not happen based on the fast I mean, based on the evidence that we investigated, because what we cannot do, we cannot sustain someone for something that we can validate. Here's what our investigators doing. Here's my mantra. My monitor is that our investigators and our cases always have to pass the microphone test. What is the microphone test? Many times in the past and maybe some of you know or don't know this, some of our cases end up in court, or some of our cases end up in disciplinary hearings, and the investigators to sign off on these reports. The supervising investigators leaving the chief investigator I have to go into the thing that this investigation so we're very careful to make sure that whatever we're putting in this report is backed by evidence for us is the evidence is the evidence is the evidence. Another finding that we have is sustained. And that is where the preponderance of the evidence shows that the alleged conduct did occur and that the actions of the officers violated these great police department policies and procedures. And we don't make the recommendations how that should happen. But we do forward it on to the necessary entities and that's taken care of on that end. And then finally, our final finding is inconclusive, and that is where there is insufficient facts to decide whether the alleged misconduct occurred in the first place. Next slide. Please. We are looking at our overall operations, how we can more effectively streamline what we do, what I was taking away from the effectiveness of our investigation. So we're looking at everything top to bottom and that's one of the things we're looking at. And we'll come to you fairly soon with the report first of all on the state of our office where we are because we got to understand who we are and how we got here. No wants to show you or or indicate to you where we believe we can go and how
we can get there. And looking forward to that.

Thank you, Mr. Warfield, welcome to the board. We'll see you in that capacity. I just want to say my nine years on this board demeanor, audit by the scent. Oh, complaint is demeanor. No other agency in this area held the main complaint like we helped them in mind, if you will know from your experience with the Commission. Certainly. And I have spoken to cheap quick cheap white about this. I haven't added confusion in terms of we need to identify these officers and what impact can we have on each officer in terms that they go forward? And you will know we recently voted? One would all type of come in I have heard from our LSA president. Mark. You don't care about civil complaint, but I care. As a officer as a citizen. I have always cared. And I think we should make an impact in terms of the outcome of our complaint. demeanor. I understand it's a seizure of young department, but the mean I just don't get it in terms of how can we conduct ourselves. Not proper in terms of professional officer. That's something and I know the ins and outs about being a police officers you will know and I have worked in an office for five years into by noting in OCI. I think we need to have an impact was she weighed in two main complaints so we can have an impact in terms of identifying the thought and what are the income these officer unknown by the commanding officer of demeanor. So I just want us to focus on that. Thank you,

We are in the process and structure our staff to give us a frequent flyer list of those officers that we know are notorious for demeanor or other complaints that we see in in a pattern that is handed dangerous. Mike, I just see in the report and maybe how we interface with the community report, because that was to make the report whether to first of all, let them know that we are we have not concluded it but maybe the process of it. And then when this was concluded, will they be notified? And if so how the second thing is listen to the secretary, and you asked him for the last week before you got started. I really want you guys to look and see the technology that's out there in order to get these to how you are getting close. To the Moon and Mars and architecture, intelligence. I'm sure that we can find a way to get things done quickly, efficiently, and you get it down. And I just feel like the technology is there. I don't know I've got a track mentality wise, but I'm just saying I just got a feeling. They're just out there. Asking if you would please try to see where the ACT found the question as to how we can do this. And we'll see we'll find the money for you. But other things said about how we replace it with the citizens in regards to beginning to the end.

We absolutely follow what with the citizens after our initial conversation with them every, like 10 days, depending on how long the investigation is we let them know when the investigations are concluded as well. So we stay in constant contact and if the citizens call in the midst of those periods that we get back with him. He certainly answered their phone call or get back with them to try and communicate the progress of our
investigations to share
Yes Just quickly, excellent reporting. And please tell the staff person I think I don't recall her name, who put us together who obviously knows a great deal about the department. Well, I want to make one comment on your pages of OCI allegations. Just start with the rest. I'd like if we could there are nine different things here that you that you reference, in terms of what we investigate. I think leaving before an arrest I think the issue of why am I being stuff Why am I being detained? I mean, is it because I have read it because my pants are sagging? Why are you saying anything to me? People have a right to be free. Of the police interference in everyday life. And I think a lot of the most of the complaints we've got some people call demeanor I don't mean at all. I call it it's an intrusive nature of some police officers that just automatically say when they see for me like Man Are they gonna stop the car? No, it isn't done in it. Somebody in there has has an outstanding arrest warrant. Something is up. I mean, it's what we call driving while black was example. What was the reason that you stopped me in the first place? Why are you talking to me? Why, you know, why am I being interfered with I think that's a separate category and I would create it as a top or detainment complaint. Yes. My
only comment. Thank you again to the shear Commissioner that actually falls under harassment. And so if citizens felt like he was driving and being pulled over because they were black, cause that falls under harassment. So it's it's kind of under the categories. Yes, man.

I missed you know you just say on the Detroit grassroots. We want to personally thank Casey crownsville for holding eight and for holding Austin chief investigators office together at a time that was really crucial and on and waiting for the arrival of our new chief investigator who was highly praised years ago for his service for putting together the format for OCI for building infrastructure in place from the DOJ at that time. So I really just want to thank AC crowns well for this service. And also I want to congratulate once again for the rival reviews Chief Investigator who's going to turn this office around that's going to make this board shine and and blamed back the morality back to the OCI and the board. Okay, sure. Enough you get two years two years. Give me a couple of your goals. What are some of your goals, you can know some of your goals, what you're trying to accomplish the next two years. I'm wondering if you can tell
me tell us I will open it up. I have to go in greater detail than we really what I wanted to do tonight, but I'll tell you a couple of things. One, is to restructure really organize the process of how we intake complaints, how we investigate complaints, to make sure that we are uniform in our efforts that every investigator is investigating these these complaints in the exact same way. No matter who you work for. That all would do that. And then finally that and this is probably something that explains more that that was going to greater detail later on. I promise you we record out on this, basically is to remove the toxic environment that's in that office. Our investigators are indicators and I'm not over exaggerating, okay. suffers from PTSD from working in that office, which is PTSD, post traumatic stress syndrome, okay. And I'm not joking. I'm not being I'm not being. I'm not being hyper static in my statements. I sat down and interviewed several of the folks who work in that office, investigators and staff and all of them have a question. We're going to work they are committed to going to work with they wants to do what's comes to work. They literally want to come to work, have their talents, their skills, their abilities, be appreciated, be able to communicate with each other work with each other to where the citizens of the city are literally enhanced and their voices are heard at levels that it hasn't been in a while. And so to build that camaraderie is a major deal for us. And again, that may be a little controversial to say, but I always speak the truth. And so so those are a few of my major goals are getting it done. And so I'm going very methodically, meeting with everyone in that office to see how can all of the talents that are in that office be represented at some level there and they can be honored
as they do. Their work. Wonderful. And those are some major goals to get in tastic out of an organization. So wish you the best chief investigator, you seem like a tenacious
young man that didn't really get after it. Here Yeah.

Thank you, Mr. Chair. And through the chair, because the secretary report today commissioners you do have on your agenda, your incoming correspondence, and I will reference those as necessary. It's Teresa bossman. I had an opportunity to meet with Dr. Rocha from Wayne State University this week to get an update on where we are with that partnership. And as part of my secretary report, I would like to pass it off to miss Lawson for just a moment to give some updates regarding that partnership.
Auto Body through the chair. This is the update on the Wayne State University, Wayne Law partnership with the board of police commissioners and 2021 as part of the ongoing commitment to the Obama Task Force recommendations. The board leadership approved staff to work with Wayne State. That work resulted in a report identifying areas of advancing oversight and transparency through better technology, data, dashboards, public friendly reports and other measures. That collaborative report was distributed as steel posted at the West site in December 2022. The board voted to add our Wednesday collaboration to our Wednesday collaboration by having us partner with law school and benefit from weighing laws participation with the American Heart Association, ABA legal education police practice and source yum. That consortium is committed to understanding and addressing legal issues and and policing and public safety. Most importantly for us, it also looks at public oversight of the evolving and challenging nature of police work. Vice Chair Holt and police commissioner Carter. You join with staff and late December to work with Professor Robert Dodd to decide the key policy areas for law students or ABA fellows to examine and kind of study and to earn class credit and produce research papers. The board's suggestions were to look at policies around use of force, facial recognition, and an autumn Vedic gunfire detection systems or ShotSpotter and the outcomes with those policies that the professor listed for law students and ABA fellows and Kayla Armstead are Dosch Wayne Kelly and David zensar. Sorry, cancer. They agreed to study the policies and public information for use of words you've got spotter I want to stress that this whole just on public information given to the board and the public each week is only available at the city's website. A core goal is to make sure information is available and as easy for the public to find and understand when it comes to transparency. And police accountability. The professor held a biweekly meeting with her fellows, and I periodically joined to answer questions or to hear possible research leads. We did extend invitations for the professor to meet with the policy committee. Commissioner Carter has spearheaded this effort with the board when she was chair of that committee. The professor remains willing to come anytime to the committee's at the community use me at the committee's convenience or at the pleasure of the board as an update. With the semester now over. The professor shared with BOARD SECRETARY Shaw and myself it's wait that one topic was completed. And that topic was on ShotSpotter. The professor is currently reviewing that paper now and expects to have a final draft or the bo PC in June. See also here they will use this semesters experience to restructure the education clinic for the fellows in the fall. Because this is an ongoing collaboration the focus is on effective research and outcomes, not just paper production. In closing, I want to again extend the board's thanks to the professor, the fellows and the collaborative nature of the project. The fellows have been great to know and work with. I want to add gratulations for graduate, David and Mikayla nobody that Mikayla who was a let the fellowship early for a fantastic job in entertainment law. We have to be the OPC server with all the students continued success. Thank you Miss Lawson. And honorable board just to continue the secretary report. I'll share my screen here just show some wires that are at the table. These are in preparation for the public hearing that will be taking place next week on May 11. At our community meeting, and we will be looking for the community's feedback on the new police surveillance specifically around the expanded use of license plate readers and so leave are a few of the informational materials that are in your packets as well as on the table for the community either also being distributed through our various electronic channels on our website as well as to our media partners. And we ask that the community review this information in preparation for providing feedback to the
board next week.
Based around budget, so I have requested the final approved item itemized budget for Bo PC and BPD and we'll share that with the board once received. What I did receive was leave your PC adopted position budget for fiscal years 2024 which shows the position that the board voted to approve on May 16 have not been approved by city council. You can see a copy of that in your packets behind me have number six the currently approved position but it only allows for 35 total staff positions rather than the 37 that the board approved and it does reduce the number of investigators that we can staff by two. This isn't being appealed to city council as these positions are important to be LPC providing effective oversight on behalf of destroyers updates regarding open positions. So as several have have congratulated today we have onboarded Chief Investigator Jerome, Jerome Warfield who started on Monday five one and I'm looking forward to the partnership and the value that he brings to the Office of the Chief Investigator. For investigators we have the five appointment of candidates they all started on Monday five one and they are in training and in addition, we have 52 New Investigator candidates who have applied to fill additional investigator positions. The applications for all 50 schools are distributed via email to all commissioners on May 3 All 52 candidates are with the chief investigator Warfield for screening based on qualifications. In addition we have an opening for supervising investigator we have one supervising investigator will also be a magical who was hired this week of effective the third position is being posted for internal promotion requisition is approved and with recruiting for posting our executive manager position for fiscal operations. We have received 20 candidates that have applied and applications for all 20 were distributed to the commissioners on five three and I'm currently screening those based on qualifications as well. In regards to the open attorney and legal assistant position, the appeal to corporate Corporation counsels decision is still being drafted. Based regarding committees at this time no committee meetings have been scheduled for me as of yet. The following are matters that are before the board and you may want to you may consider having these handled by committee, budget disciplinary BPD administrative requests and when there are no items at this time for personnel and training. This is the committee chaired by Commissioner Hey Soos Hernandez we still have two DPD applicant appeals that needs to be addressed Jaylen Johnson the second and Rashid Hickson just citizen complaints chair by Commissioner Cedric banks we have the citizen complaint appeal process used by city charter section seven dash 809 resolution of complaints. Currently the staff is reviewing the standard operation procedures and developing recommendations to take to that committee. Finally the policy committee chaired by Commissioner Willie Burton. We have the license plate reader specification report, which is going before the community on next week for public hearing and then said additional policies that are before the Board staff will continue to review and schedule public hearings to get public feedback for the full board consideration. Last item from my secretary report, I will provide a base regarding the status of cases with OCI. If we can bring that slide but please.

All right. So for citizen complaint
updates. So for our
recent improvements in initiatives, supervisors are continuing to coach investigators on managing inventory management strategies to drive more consistent production while maintaining thorough investigations. And again, just really happy to have Chief Investigator Warfield on board now to provide more focus to this and I'm looking forward to the improvement that he'll be making with that team. Well, I'll see i admins are back in the office gladly and the front end back end processes are back on track. We can go to the next slide please. And we can skip past this slide. These are just definitions and clarification or process. All right. And so as far as our total open cases by age, we do have still an increase from last week in the total number of cases from 545 to 561. And we are holding steady with the number of cases that are aged 91 days and older. And we do have additional cases that have come in and into the lower category of zero to 60 days. Next slide please. We have 25 closed cases that are currently review of commissioners we are expecting those back today. Some of you have turned those in and we have 20 closed cases that are being distributed today for review. Next slide or 2023 performance so we have added the performance for April. And in April we did receive 131 cases and the team calls 81 cases. So again, we are understaffed at LCI right now, we do need to start to close more cases in the month then we're receiving in and we're not at that point yet. So looking forward to the additional five investigators that will be coming out of training in the next couple of weeks so that they can start to assist with inventory. We can go to the next slide. update regarding the 2023 cases though so far in 2023. We have had 463 cases received and 178 of those cases are closed. 122 of them were closed in 60 days 48 were closed between 61 and 90 days and we had eight that actually closed over 90 days. We did have an update to one case, where the case had to be opened again some adjustments made and closed at a later time and so it has moved from one bucket to the other. But overall we are seeing that we are closing more cases in the allotted time frame. Next slide. And then as far as our cases that have been received in 2023 that are still open, we have 25 of them are aged over 90 days, and 40 of them are approaching 90 days and so the team is is putting extra focus on last cases to make sure we do not continue to contribute
to the backlog.

That's what we're gonna have to do moving forward because no one is getting with permission to hurt and to lend their support on that policy. But we got to move forward. So this is what we're gonna do. We're gonna put out the policy that's before us. When the DVD give it to us. We will send it out to delivery dogs and other media services, whether it's the news or whether it's anybody and have the public come here and review that policy when they get it and have them weigh in on this changes. They want to see something that they don't like, right? And then when they do that the
full board
is gonna make the recommendation on how that should go. And that's how we're going to have to move forward. We

And and I respect that Commissioner for going by it the right way. But this committee has been trying to get things out awesome ball shooting policy gunshot detective policy. There's a policy that this board has voted on voters to create a policy on what the police department can receive or not received from the Department of Defense, whether it was the 1030 program or the change 22 program. And this was something that we voted on a few years ago that policy have not been graded. In addition to that we have a policy director have not been present. Because that person I guess, taking some leave or or whatever is going on, have not been here so we don't even have so we don't even have the Policy Director or or or anyone to help with this. What's his policy? Body parts can be the committee has done some work or as citizens complaints. policy. We have reviewed laser recommendations. I can't get it passed without you being present as the ex officio of this body. Thank you. So there's policies that we kind of review this week. Let me clear some of that life itself. the Quorum of a committee can never been dependent on your presents. So even if you show up at a committee meeting, and they say okay, now we have a quorum. No, they don't. You are not part of that form for the committee. So ex officio gives you certain rights but you're not required to under the right cause after duty. So any committee is because x a quorum and you show up, it still does not have a quorum. It has to be a regularly appointed member of that. Committee. And in terms of the LMA, I'm pretty clear and trending fast. We can help. We never can have a quorum of a commission make up this committee, then that's a violation of Open Meetings.
